No if it’s not overdue.
If the amount owed reaches more than RMB 50,000 and is still not returned for more than 3 months after two collections by the card-issuing bank, it shall be deemed a malicious overdraft under the criminal law and suspected of credit card fraud. If the malicious overdraft amount is relatively large and all the overdraft interest has been repaid before the public security organ files the case, and the circumstances are obviously minor, criminal liability may not be pursued in accordance with the law. Negotiate repayment with the bank as soon as possible. If the other party sues you, you will most likely be enforced. You will not be able to apply for credit business at the bank within 5 years from the date of paying off the debt. If the credit card debt is not repaid, the bank will collect it through multiple channels. If it indicates repayment and makes a repayment plan, and actually performs it, the bank will not report the case and treat it as a criminal case. If you refuse to repay, the bank will usually sue through civil means, and only if you fail to repay will the case reporting process be initiated. If the police file a case and then fail to repay the loan, it may constitute credit card fraud.
As long as the money is owed, the bank may sue, which is at the bank's discretion.
