Legal analysis: If the People’s Court fails to execute the application for more than six months from the date of receipt of the execution application, the person applying for execution may apply to the People’s Court at the next higher level for execution. After review, the people's court at the next higher level may order the original people's court to implement within a certain period of time, or may decide to have this court implement the case or instruct another people's court to implement it.

Article 18 The Intermediate People’s Court has jurisdiction over the following first-instance civil cases:
(1) Major foreign-related cases;
(2) There are Cases with significant impact;
(3) Cases determined by the Supreme People's Court to be under the jurisdiction of the Intermediate People's Court.
Article 119: A lawsuit must meet the following conditions:
(1) The plaintiff is a citizen, legal person or other organization that has a direct interest in the case;
(2) There is a clear defendant;
(3) There are specific litigation claims, facts and reasons;
(4) It falls within the scope of the People’s Court to accept civil litigation and It shall be under the jurisdiction of the people's court subject to the lawsuit.
