Legal analysis: In this case, the cardholder can only find ways to repay the loan as soon as possible, not more than three months, and can borrow money from relatives and friends for turnover. Credit cards overdue for more than 2 months will be frozen (see bank regulations for specific time), and generally they can only be deposited but not withdrawn. 3. Bad credit records will have a negative impact on applying for credit cards or loans again in the future, and the credit limit of existing cards will also be reduced. Under normal circumstances, if the cardholder is overdue for three times (short overdue), the bank will report it to the central bank, and the central bank system will give a bad credit record. Those within three times will only be displayed in the bank. Banks usually reserve a two-day "grace period" for customers, that is to say, even if customers repay within two days after the "last repayment date", they will generally not be regarded as "overdue repayment".

Legal basis: Article 196 of the Criminal Law of People's Republic of China (PRC) commits credit card fraud under any of the following circumstances. The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank. Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
