In the event of divorce, the debts originally incurred by the husband and wife while living together shall be * **Same repayment. If the property of the two parties is insufficient to repay the debt, or if the property belongs to each other, the repayment shall be settled by agreement between the two parties; if an agreement cannot be reached, the People's Court shall make a judgment.

Article 42: During divorce, if one party has difficulties in living, the other party shall provide appropriate assistance from his/her personal property such as house. The specific measures shall be agreed upon by both parties; if agreement cannot be reached, the People's Court shall make a ruling.

Article 18 If any of the following circumstances occurs, it shall be the property of one spouse :

(1) One party’s pre-marital property;

(2) One party’s medical expenses, living allowances for the disabled, etc. due to physical injuries;

(3) Property determined in the will or gift contract to belong only to the husband or wife;

(4) Daily necessities used exclusively by one party;

(5) Others that should belong to one party property.

Article 19: Husband and wife may agree that the property acquired during the marriage and the property before marriage shall be owned by each other or jointly, or may be partly owned by each and partly jointly. The agreement should be in writing. If there is no agreement or the agreement is unclear, the provisions of Articles 17 and 18 of this Law shall apply. The agreement between husband and wife regarding the property acquired during the marriage and the property before marriage shall be binding on both parties. If a husband and wife agree that the property acquired during the marriage shall be owned by each other, and if a third party is aware of the debt borne by either husband or wife, the debts borne by the husband or wife shall be paid off with the property owned by the husband or wife.
