Legal analysis: the overdue investigation of credit cards depends on the situation. Normal overdue is a civil dispute, not under the jurisdiction of economic investigation. However, if the credit card is overdue for more than three months or the bank reminds it twice that it has not been repaid, the bank will freeze it and list it as a prohibited customer (blacklist). At the same time, they will contact the police station to summon individuals. If they refuse to pay back the money, they will sue for credit card fraud and malicious overdraft.
Legal basis: Article 196 of the Criminal Law of People's Republic of China (PRC) shall be sentenced according to the overdraft amount under any of the following circumstances. (a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate; (2) Using an invalid credit card; (3) Fraudulent use of another person's credit card; (4) malicious overdraft.
