1. If the perpetrator steals and uses a credit card, the property rights of others are infringed;
2. If a large amount of public or private property is stolen, or theft, burglary, theft with a weapon or pickpocketing is repeated, it constitutes theft, and it is generally punished with fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and a fine or a single fine;
3. If the amount of theft is huge or the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years, and shall also be fined.
The theft and use of credit cards generally includes the following situations:
(1) The perpetrator steals a genuine and valid credit card and uses it;
(2) The perpetrator stole a forged or invalid credit card, but the perpetrator did not know that it was a forged or invalid credit card and used it;
(3) The actor knows that the stolen credit card is a forged credit card, or that it is an invalid credit card, and after technical operation, the dead card is restored to function and used;
(4) The perpetrator stole the credit card with false identification and used it.
