How to file a case when a credit card is stolen

Legal analysis: When a credit card is stolen and swiped, the public security organ shall file a case: that is, the perpetrator fraudulently uses another person's credit card, and the amount is more than 5, yuan, which may constitute the crime of credit card fraud, and the public security organ shall file a case. Or if the perpetrator steals another person's credit card and swipes one thousand yuan or more, it may constitute theft, and the public security organ shall also file a case.

Legal basis: Article 54 of the Provisions of the Ministry of Public Security of the Supreme People's Procuratorate on the Standards for Filing and Prosecuting Criminal Cases under the Jurisdiction of Public Security Organs shall be filed for prosecution if it is suspected of any of the following circumstances:

(1) Using forged credit cards, or using credit cards fraudulently obtained with false identification, or using invalid credit cards, or fraudulently using other people's credit cards to engage in fraudulent activities with an amount of more than 5, yuan;

(2) Malicious overdraft, the amount of which is more than 1, yuan.

Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Laws in Handling Criminal Cases of Theft Article 1 Whoever steals public or private property with a value of 1, to 3, yuan or more, 3, to 1, yuan or more, and 3, to 5, yuan or more shall be deemed as "a large amount", "a huge amount" and "a particularly huge amount" as stipulated in Article 264 of the Criminal Law respectively.
