The handling method for overdue credit card repayments is as follows:
1. Continue to use it. After it is overdue, the best way is to continue to use this card and use the new normal repayment method. When the record overwrites the original negative record, a new credit record will generally be generated so that personal credit, etc., will not be affected after the record is refreshed. If you are overdue for a long time, your credit card will accumulate interest and there will be high late payment fees. If you run away, the bank will determine that you have maliciously overdrafted and will call the police;
2. Apply for delayed repayment if you are unable to make on time due to unemployment or illness. To repay the loan, before the final repayment deadline, state your financial situation and declare that you do not owe the money maliciously. You can apply for delayed repayment and interest discounts;
3. Repay the loan in full and in a timely manner. If you are careless and forget to repay, you must repay in full as soon as possible after you find it is overdue, preferably in full, because after repaying in full, you have the best chance of winning if you call the bank to explain that the debt is not malicious and request to eliminate the overdue record. Don’t think that it only affects you, your spouse and children are also affected. By that time, there will be no regrets, and the credit report will not believe the tears.
Legal basis: "Interpretation on Several Issues Concerning the Specific Application of Laws in Handling Criminal Cases Obstructing the Management of Credit Cards"
The cardholder exceeds the prescribed limit or regulations for the purpose of illegal possession. If a time-limited overdraft is not returned for more than three months after two effective calls by the card-issuing bank, it shall be deemed a "malicious overdraft" as stipulated in Article 196 of the Criminal Law.
For the purpose of illegal possession, the cardholder’s credit record, repayment ability and willingness, the status of applying for and overdrafting the credit card, the purpose of the overdraft funds, the performance after the overdraft, and failure to comply with regulations should be considered. The reasons for repayment and other circumstances shall be judged. The purpose of illegal possession shall not be determined solely based on the fact that the cardholder failed to repay the loan as required.
