According to Article 144, Chapter XII, Book II of the Civil Procedure Law of the People's Republic of China:
If the defendant refuses to appear in court without justifiable reasons after being summoned by summons, or withdraws from court without the permission of the court, he may make a judgment by default.
after receiving the court summons, the defendant shall appear in court as scheduled to participate in the proceedings. It is the defendant's right to participate in litigation, that is to say, in the process of attending litigation in court, the defendant can state his own views and evidence to the court, and the court will make a judgment based on the evidence of both parties.
If the defendant does not appear in court, it is a punishment for his litigation rights, and the judge will make a determination of the facts and make a judgment based on the evidence submitted by the plaintiff. Therefore, not appearing in court is extremely unfavorable to the defendant.
