How long the credit card is overdue is determined according to the bank's regulations. Generally speaking, if it is not returned within 3 months after being collected by the bank, it is considered as a black account. If the credit card is maliciously overdrawn, it will generate high interest and penalty interest. If the circumstances are serious, it is also suspected of a criminal offence.

Article 1 19 of the Civil Procedure Law of People's Republic of China (PRC).

Prosecution must meet the following conditions:

(1) The plaintiff is a citizen, legal person and other organization that has a direct interest in the case;

(2) Having a clear defendant;

(3) Having specific requests, facts and reasons;

(4) It falls within the scope of civil litigation accepted by the people's court and is under the jurisdiction of the sued people's court.

Article 673 of the Civil Code

If the borrower fails to use the loan according to the agreed purpose, the lender may stop issuing the loan, recover the loan in advance or terminate the contract.
