Regulations on Disciplinary Punishments of the Communist Party of China

Article 70 Whoever violates the principle of democratic centralism and commits any of the following acts shall be given a warning or a serious warning; In serious cases, sanctions such as removal from party positions or probation will be given:

(1) Refusing to implement or changing major decisions made by the party organization without authorization;

(2) Violating the proceedings According to the rules, an individual or a small number of people decide on major issues;

(3) Deliberately circumventing collective decision-making and deciding on major matters, the appointment and dismissal of important cadres, the arrangement of important projects and the use of large amounts of funds;

(4) Violating collective rules in the name of collective decision-making.

Democratic centralism is the party’s fundamental organizational principle and an important institutional guarantee for the normal development of intra-party political life. The Party Constitution stipulates six basic principles of democratic centralism. "Several Guidelines on Inner-Party Political Life under the New Situation" clearly stipulates that "resolutely oppose and prevent arbitrariness or self-governance, resolutely oppose and prevent discussions without making decisions, decisions without action, and actions without practicality, and resolutely oppose and prevent the party committee collective Collective violations in the name of decision-making" etc.

Item (3) stipulates the behavior of deliberately avoiding collective decision-making and deciding on major matters, the appointment and dismissal of important cadres, the arrangement of important projects and the use of large amounts of funds. "Deliberately avoiding collective decision-making" mainly refers to individuals or a small number of people deliberately violating relevant rules of procedure and decision-making procedures, failing to make decisions on the "three major and one major" matters within their responsibilities in the form of collective discussions and meeting decisions, or in emergencies. Ad hoc decisions made by an individual or a small number of people, failure to report to the team in a timely manner afterwards, etc. The "three major and one major" matters mainly refer to major matters, the appointment and removal of important cadres, the arrangement of important projects and the use of large amounts of funds.

Item (4) stipulates collective disciplinary violations in the name of collective decision-making. Although this kind of disciplinary violation complies with the collective rules of procedure and decision-making procedures, there is the fact that collective decision-making is illegal, and the collective decision-making process becomes a way and means to cover up the purpose of collective violations.
