1, according to the provisions of China's Marriage Law, if the debts incurred by husband and wife before marriage are personal debts, they shall be borne independently by both parties and shall not be treated as joint debts of husband and wife. During the existence of the relationship between husband and wife, if one of the husband and wife undertakes foreign debts in his own name and agrees with the debtor, it will also be regarded as personal debts, and the other party will not be liable for repayment.

2. If the debts incurred by one spouse during the marriage relationship are not clearly personal debts, they shall be treated as joint debts of husband and wife, and both spouses shall be jointly and severally liable for the debts. At the same time, the debts assumed by one spouse before marriage, which are used for husband and wife to live together after marriage, are also treated as joint debts of husband and wife.

3. If the credit card overdraft occurs during the relationship between husband and wife, and the credit card expenditure does bear a part of the family living expenses, therefore, the credit card debt should be recognized as the joint debt of husband and wife, and both husband and wife have the obligation to repay it jointly.
