First, the Head Office of the People's Bank of China is drafting a bank card regulation with the CBRC, and will consider increasing the recognition and punishment standards for credit card cashing.
The second is to promote the industrial and commercial departments to incorporate the relevant provisions on cracking down on cash-out merchants and cash-out cardholders into the punishment measures for market violations, and clarify the illegal acts of fraudulent credit card consumption transactions to defraud bank funds, as well as engaging in or engaging in financial services such as credit card fund lending in disguise for the purpose of defrauding bank funds, and impose administrative penalties.
The third is to promote the inclusion of cracking down on credit card cashing in the criminal law. Article 196 of the Criminal Law defines the cardholder's malicious overdraft as the crime of credit card fraud, but the problem of cashing out credit card merchants is not within the jurisdiction of the Criminal Law at present. At present, the head office of the People's Bank of China is actively pushing the relevant legislative departments to make the cashing of merchants' credit cards a criminal offence by amending the criminal law or interpreting relevant laws.
