In accordance with the requirements of "Guiding Opinions of the State Council on Establishing and Perfecting the Joint Incentive System of Trustworthiness and the Joint Punishment System of Trustworthiness to Accelerate the Construction of Social Integrity" (Guo Fa [2016] No.33), in order to prevent some passengers' illegal and untrustworthy behaviors from adversely affecting the safety of railway operation and further increase the punishment for serious illegal and untrustworthy behaviors in other fields, we hereby put forward the following opinions on restricting some serious untrustworthy personnel from taking the train.

First, limit the scope.

(a) the person responsible for the behavior that seriously affects the safety of railway operation and production is punished by the public security organ or recognized by the railway station and car unit.

1. Disrupting the transportation order of railway stations and cars, endangering railway safety and causing serious social adverse effects;

2. Smoking on EMU trains or smoking in non-smoking areas of other trains;

Investigate and deal with scalping and making and selling fake tickets;

4. Fraudulent use of preferential (pending) identity documents, using forged or invalid preferential (pending) identity documents to purchase tickets;

5. Take a forged, expired and other invalid tickets or report the loss by fraudulent use of replacement tickets;

6. Traveling without a ticket, passing the station (seat) and refusing to make up the ticket;

7. Administrative punishment shall be given according to relevant laws and regulations.

Restrict those responsible for the above acts from taking the train.

(2) Persons responsible for serious violations of law and dishonesty in other fields.

1. A party to a major tax violation case who has the ability to perform and refuses to perform;

2. In the field of financial fund management and use, there are those responsible for serious dishonesty such as fraud, false reporting, interception and misappropriation, and arrears of debts due from international financial organizations and foreign governments;

3. In the field of social insurance, there is a person responsible for serious dishonesty in the following situations: the employer fails to participate in social insurance according to relevant regulations and refuses to rectify; The employer fails to truthfully declare the social insurance payment base and refuses to rectify; Should pay social insurance premiums and have the ability to pay them but refuse to pay them; Concealing, transferring, occupying or misappropriating social insurance funds or illegally investing and operating; Defrauding social insurance benefits by fraud, forgery of certification materials or other means; The social insurance service institution violates the service agreement or relevant provisions; Refusing to assist the administrative department of social insurance in investigating and verifying accidents and problems;

4. Securities and futures are fined for violating the law and have not been paid within the time limit; The relevant responsible subjects of the listed company fail to fulfill their public commitments within the time limit;

5 by the people's court in accordance with the relevant laws and regulations to take measures to limit consumption, or be included in the list of people who have lost their trust;

6. Other persons responsible for serious dishonesty who are restricted from taking high-level seats on the train as determined by the relevant departments. If relevant departments join this document, it should be clarified by modifying this document.

Those responsible for the above acts are restricted to take high-level seats on trains, including train soft sleepers, all seats on G-prefix EMU trains and first-class or above seats on other EMU trains.

Second, information collection.

(A) Railway passengers dishonesty related information collection

If the above-mentioned acts occur in railway stations and carriages, and the public security organs give administrative punishment or put a criminal case on file, the relevant railway public security bureau will notify the relevant railway bureau group Co., Ltd. and include it in the disciplinary list. For the above-mentioned acts that have not been dealt with by the public security organs, the railway station staff shall collect the relevant audio-visual evidence or witness testimony of two or more passengers or the written proof of the person responsible for the acts, and report them to the railway transport enterprise for examination and confirmation before being included in the disciplinary list.

(2) Collection of untrustworthy information in other fields.

The National Development and Reform Commission, the Supreme People's Court, the Ministry of Finance, Ministry of Human Resources and Social Security, the State Administration of Taxation, and the China Securities Regulatory Commission collected the list of high-level seats that need to be included in the train restriction due to serious dishonesty determined by this department into the national credit information sharing platform, which pushed it to the railway head office, which was included in the list of high-level seats for train restriction according to the procedures prescribed by the state. If the data transmission channel and list information sharing have been established with the railway head office before, the original traditional data channel and information sharing mode can be maintained, and the national credit information sharing platform will not push the list information repeatedly.

The list information provided to the railway head office shall include: name, travel document number, reasons for inclusion, and name and number of legal documents (if any). The relevant departments shall determine the list of objection handling personnel and notify the railway corporation.

Three. Release, execution and right relief

On the first working day of each month, all railway transport enterprises publish the complete information of the list of restricted ticket purchasers on the websites of China Railway Customer Service Center (12306) and Credit China, and at the same time publish the contact information of the objection handlers of relevant departments. The publicity period is 7 working days from the date of publication of the list. During the publicity period, the publicized person can raise objections through the railway "12306" customer service telephone or to the relevant departments. Upon the expiration of the publicity period, if the publicized person fails to raise an objection or the objection is not supported after examination, all railway transport enterprises will start to implement disciplinary measures according to the publicity list. Persons who are included in the restricted ticket purchase list may submit a review to the relevant organs and units if they think that they are included in the list in error.

Fourth, the clearance mechanism.

Appropriate restrictions on taking the train for some serious untrustworthy people within a certain period of time. After the relevant subjects are removed from the list of passengers who are restricted from taking the train, they will no longer be restricted from taking the train. The specific removal method is as follows:

(1) If the person responsible for the act seriously endangers the safety of railway operation and production, according to the provisions of Articles 1 ~ 3 and 7, all railway transport enterprises will restrict their ticket purchase, and the validity period will be 180 days, counting from the date when there is no valid objection at the expiration of the announcement. When 180 days expires, they will be automatically removed from the list, and the railway transport enterprises will resume selling tickets to them.

(two) if the person responsible for the act seriously affects the safety of railway operation and production, the railway transport enterprise shall restrict its ticket purchase. After the person responsible for the act makes up the fare owed (calculated from the day after the ticket is replenished), the railway transport enterprise will resume ticket sales; Within one year after the person responsible for the act makes up the fare owed for the first time, if the above 4 ~ 6 acts occur three times, the railway transport enterprise shall resume ticket sales 90 days (including 90 days) after the person responsible for the act makes up the fare owed, and the railway transport enterprise shall not resume ticket sales without making up the fare owed.

(3) The list of relevant personnel who are restricted from taking high-level seats on trains in other fields is valid for one year, counting from the date of expiration of the publicity, and will be automatically removed at the expiration of one year; Within the validity period, if its legal obligations are fulfilled, the relevant departments shall notify the railway head office to remove the list within 7 working days.
