According to the principle that substance is more important than form, Shanghai Futures Exchange determines that the actor has actual control over the trading of other people's futures accounts under one of the following circumstances: (1) The actor is the controlling shareholder of others; (2) The actor acts as another person's account opening authorizer, designated orderer, fund distributor, statement confirmer or other forms of entrusted agent; (3) The actor is the legal representative, major partner, director, supervisor or senior manager of another person, or the actor is consistent with the legal representative, major partner, director, supervisor or senior manager of another person; (4) The actor has a spouse relationship with others; (5) The actor has the relationship of parents, children, brothers and sisters with others, and has the decision power or significant influence on the daily trading decisions of other people's futures accounts; (6) The actor, through investment relationship, agreement, financing arrangement or other arrangements, can have decision-making power or significant influence on the daily trading decisions of other people's futures accounts; (seven) the actor has the decision-making power or significant influence on the daily trading decisions of two or more other people's futures accounts; (8) Other circumstances identified by the Exchange. At present, the futures exchange implements the filing system for the actual control relationship accounts.
The reason why investors are required to declare the actual control relationship account is to strengthen the front-line supervision of the futures market, curb excessive speculation, crack down on illegal acts, protect the legitimate rights and interests of investors, and maintain the stable and healthy operation of the futures market.
