The newly revised "Regulations on Disciplinary Treatment of Professional and Technical Personnel Qualification Examination" has been considered and adopted at the 53rd ministerial meeting in Ministry of Human Resources and Social Security, and is hereby promulgated, and shall come into force as of May 201year. The Regulations on Disciplinary Handling of Professional and Technical Personnel Qualification Examination issued by the Ministry of Personnel on June 20, 2004 (Order No.3 of the Ministry of Personnel) shall be abolished at the same time.

Chapter I General Principles
Article 1 These Provisions are formulated in accordance with relevant laws and regulations in order to strengthen the management of professional and technical personnel qualification examination, ensure the fairness and justice of the examination, standardize the identification and handling of violations of discipline and discipline, and safeguard the legitimate rights and interests of candidates and examination staff.
Article 2 These Provisions shall apply to the identification and handling of violations of discipline and discipline in the qualification examination of professional and technical personnel.
Article 3 The qualification examination for professional and technical personnel as mentioned in these Provisions refers to the examination related to the evaluation and appointment of professional and technical posts, the qualification examination for professional access and the examination for professional level, which is determined by Ministry of Human Resources and Social Security or held jointly with relevant administrative departments nationwide.
The candidates mentioned in these Provisions refer to those who take the examination according to the relevant provisions of the qualification examination for professional and technical personnel.
The term "examination staff" as mentioned in these Provisions refers to those who participate in the examination management and service, including those who are responsible for the examination questions (volumes), invigilators, invigilators, patrol papers and marking papers, as well as the relevant staff of the examination authorities and examination institutions.
The competent examination department mentioned in these Provisions refers to the administrative departments of human resources and social security at all levels, relevant administrative departments and industry associations or societies with examination management functions according to laws and administrative regulations.
The term "examination institutions" as mentioned in these Provisions refers to the units that are responsible for the qualification examination of professional and technical personnel at all levels with the approval of the government and its relevant departments.
Article 4 The identification and handling of violations of discipline and discipline shall be based on clear facts, conclusive evidence, standardized procedures and accurate applicable provisions.
Fifth Ministry of Human Resources and Social Security is responsible for the comprehensive management and supervision of the national professional and technical personnel qualification examination.
Examination departments at all levels, examination institutions or relevant departments shall, in accordance with the examination management authority and these Provisions, identify and deal with the violations of discipline and discipline of examination staff.
Local examination departments and examination institutions at all levels shall, in accordance with these provisions, identify and deal with candidates' violations of discipline and discipline. Among them, serious violations of discipline and discipline that have a significant impact shall be identified and handled by the provincial examination institutions jointly with the provincial examination institutions or by the provincial examination institutions, and the handling situation shall be reported to the examination institutions in Ministry of Human Resources and Social Security and the corresponding industries.
Chapter II Handling of Candidates' Violation of Discipline and Discipline
Article 6 If a candidate commits one of the following acts in the examination, the examination result of this subject is invalid:
(1) bringing articles other than those specified into the examination room and failing to place them in the designated position according to the regulations;
(2) Failing to fill in (fill in) my information after being reminded;
(3) Writing personal information in a position other than that specified in the examination paper, or marking information in other ways;
(4) Failing to sit in the examination according to the provisions, or leaving the seat or examination room without the permission of the examination staff;
(five) did not use the prescribed pen and paper to answer, or the handwriting before and after the test paper is inconsistent;
(6) transmitting and receiving information through voyeurism, whispering and gesturing;
(seven) reading reference materials in violation of regulations;
(eight) before the test signal is issued, or after the test signal is issued, continue to answer questions;
(9) Other general violations of discipline.
Article 7 If a candidate commits one of the following acts during the examination, the examination results of all subjects in that year will be invalid; Among them, one of the acts in Items (3) to (8) shall not participate in the qualification examination of various professional and technical personnel within 2 years:
(1) Plagiarizing or assisting others to plagiarize answers to test questions or materials related to test contents;
(2) Passing examination papers, answer sheets, answer sheets and draft papers to each other;
(3) Deliberately damaging examination papers, answer sheets and answer sheets, or taking them out of the examination room;
(4) Forging or altering certificates or certificates, or obtaining examination qualifications by other improper means;
(five) let others take the exam as an impostor;
(six) after I left the examination room and before the end of the examination, I disseminated the examination questions and answers;
(seven) colluding with the examination staff or participating in organized cheating;
(eight) the use of communication tools, electronic products or other technical means to send and receive information related to the examination;
(nine) other serious violations of discipline.
Eighth candidates should consciously maintain the order of the examination workplace, obey the management of the examination staff, and be ordered to leave the examination room in one of the following acts; Affect the normal examination, depending on the seriousness of the case, in accordance with the provisions of article sixth or seventh; Violation of the "People's Republic of China (PRC) Public Security Administration Punishment Law" shall be dealt with by the public security organs according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(1) Deliberately disturbing the order of test sites such as test sites and examination rooms;
(2) refusing or obstructing the examination staff from performing their management duties;
(3) Threatening, insulting, slandering or framing others;
(four) other acts that disrupt the order of examination management.
Article 9 Where false certification materials are provided or corresponding certificates are obtained by other improper means, the issuing authority shall declare the certificate invalid, withdraw the certificate and deal with it in accordance with Article 7 of these Provisions. Those who are involved in professional access qualifications may not take the qualification examination within 3 years.
Tenth instead of others to take the exam, 2 years shall not participate in all kinds of professional and technical personnel qualification examination.
Chapter III Handling of Disciplinary Violations by Examination Staff
Eleventh examination staff in any of the following circumstances, stop their continuing to participate in the examination work in the current year and next year, and be punished by the examination institution, the examination department or the relevant departments:
(a) do not strictly grasp the registration conditions;
(two) to advance the start time of the examination, postpone the end time of the examination and shorten the examination time without authorization;
(3) changing the examination room or seat for candidates without authorization;
(4) Prompting or suggesting candidates to answer;
(five) did not accurately record the examination room and violations of discipline, and caused a certain impact;
(6) Failing to perform their duties seriously, resulting in disorder in the examination room or identical examination papers in the examination room;
(seven) the withdrawal system is not implemented;
(eight) other general violations.
Article 12 Under any of the following circumstances, the examination institution, the competent examination department or the relevant departments suggest that the examination staff be transferred from the examination post and may not engage in the examination work again, and be given corresponding punishment:
(a) due to life (trial) problem (volume) mistakes, resulting in serious consequences;
(two) to assist others to obtain the examination qualification or obtain the corresponding certificate by improper means;
(three) because of dereliction of duty, the candidates failed to take the examination as scheduled, or suffered heavy losses in the examination work;
(4) Taking the examination paper, answer sheet, answer sheet and draft paper out of the examination room or giving it to others without authorization;
(5) Deliberately damaging examination papers, answer sheets and answer sheets;
(six) tampering, fabricating or lying about the inspection data and information without authorization;
(seven) the disclosure of information that should be kept confidential during the inspection;
(eight) in the marking work, without changing the scoring standard or not marking according to the scoring standard;
(nine) due to dereliction of duty in marking work, resulting in wrong marking results, resulting in serious consequences;
(10) instigating or conniving others to cheat, or participating in collusion and cheating inside and outside the examination room;
(eleven) lax supervision, resulting in a large area of cheating in the examination room;
(12) Unpacking unopened papers, answer sheets, etc. or sealed papers, answer sheets, answer sheets, etc. without authorization. Finish the exam;
(thirteen) taking advantage of the examination work, abusing power for personal gain or taking revenge on candidates;
(fourteen) other serious violations of discipline and law.
Thirteenth examination staff in violation of the "People's Republic of China (PRC) Law on Guarding State Secrets" and other relevant provisions, resulting in the leakage or loss of examination questions, papers and related materials during the confidentiality period, the relevant departments shall, depending on the seriousness of the case, punish the responsible person and the relevant responsible person respectively; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter IV Handling Procedures
Fourteenth candidates found on the spot violations of discipline, the examination staff should verify the situation, truthfully record, collect and save the corresponding evidence materials, inform the contents of the record on the spot, and ask them to sign. Refuse to sign, two examination staff shall truthfully record. After the record of violation of discipline and discipline is signed by the person in charge of the test center, it shall be submitted to the examination institution or the competent examination department.
Candidates who use articles in violation of discipline and regulations shall keep a receipt.
Article 15 In the marking work, if any of the following circumstances is found, the examination institution or the competent examination department shall, according to the opinions of the marking expert group, identify it as cheating papers and give the examination results of this subject invalid treatment:
(a) the text expression of the answer to the same subject test paper, the main errors are highly consistent, or the number of errors reaches a certain proportion (that is, the same test paper);
(2) Failing to fill in (fill in) my information as required;
(3) Under any of the circumstances listed in Item (3) and Item (5) of Article 6.
Article 16 Before making a decision on handling candidates who violate discipline and discipline, the examination institution or the competent examination department shall examine the facts and relevant evidence of violation of discipline and discipline, inform the candidates of the reasons and basis for making the decision, and inform them of the right to make statements and defend themselves.
If a decision is made to deal with a candidate's violation of discipline and discipline, the examination institution or the competent examination department shall make a decision to deal with the violation of discipline and discipline in the examination and deliver it to the candidate who has been dealt with in time.
Seventeenth candidates who are dissatisfied with the decision may apply for administrative reconsideration or bring an administrative lawsuit according to law.
Eighteenth examination staff have violations of discipline, in accordance with the relevant provisions.
If the examination staff refuses to accept the disciplinary action, they may lodge a complaint according to law.
Nineteenth there are violations of discipline and discipline listed in these Provisions and the corresponding personnel, the provincial examination institutions or examination departments shall publish relevant information to the public.
Chapter V Supplementary Provisions
Twentieth in accordance with the provisions of two years or three years shall not participate in the professional and technical personnel qualification examination period, shall be calculated on an annual basis from the date of violation.
Candidates who have been dealt with can register within the time limit specified in the preceding paragraph, but they should take the qualification examination for professional and technical personnel after the expiration of the time limit.
Article 21 These Provisions shall come into force on May 20 1 1, 1. The Regulations on Disciplinary Handling of Professional and Technical Personnel Qualification Examination issued by the Ministry of Personnel on June 20, 2004 (Order No.3 of the Ministry of Personnel) shall be abolished at the same time.
