Article 2 is amended as: "These Interim Provisions are applicable to all air transport enterprises in China (including airports, docks and sales agents, the same below)." Article 3 Fine items
(a) without the approval of the competent price department of the state and the Civil Aviation Administration, raising or lowering the domestic air passenger and cargo prices without authorization, disrupting the aviation market. According to the seriousness of the case, a fine of 1 10,000 yuan to 20,000 yuan will be imposed.
(two) without the approval of the Civil Aviation Administration or the local price departments at or above the municipal level, without authorization, collect the service fees and handling fees from the passengers and shippers or raise the charging standards. In addition to returning the illegally collected fees to passengers and shippers, a fine of 1000 to 5,000 yuan will be imposed depending on the seriousness of the case.
(3) Failing to act according to the rules and regulations of air transport, neglecting their duties, resulting in a third-class (including third-class) or above transportation accident. Air transport enterprises or insurance companies shall, in addition to compensating passengers or shippers according to regulations, also impose fines according to the level of accidents:
First-class accident: a fine of 30,000 yuan;
Secondary accident: fine 10000 yuan;
Grade III accident: a fine of 5,000 yuan.
After the accident, if the air transport enterprise fails to seriously investigate and deal with it in time and fails to report to the regional civil aviation administration or the civil aviation administration, it will be fined twice once it is found.
(4) Failing to manage and take safety measures according to regulations, and losing or stealing luggage and articles during storage and transportation in the warehouse. In addition to compensation as required, a fine shall be imposed according to item (3).
(5) When acting as an agent for other domestic airlines to sell their business, they don't sell tickets or pick up goods when there are vacancies, tonnage, passengers and goods, resulting in artificial flight shortage and economic losses to the airlines they represent. A fine shall be imposed according to the amount of loss, but the maximum amount shall not exceed 10000 yuan.
(6) If a passenger or shipper complains to the Civil Aviation Administration, the Regional Civil Aviation Administration or other departments because of unfair treatment or damage, and it is verified that it is really the responsibility of the air transport enterprise, in addition to an apology or compensation from the enterprise leader, a fine of 5000 yuan to 10000 yuan will be imposed depending on the seriousness.
(seven) due to poor management of enterprises, enterprise personnel in any of the following circumstances, according to the amount of personal illegal income or physical value of ten times the personal enterprise shall be fined, but the maximum fine shall not exceed thirty thousand yuan.
1. colluding inside and outside to resell tickets;
2. Take advantage of their authority to ask for bribes from passengers and shippers;
3. Privately steal the materials on the ship.

(2) Item (2) of Article 3 is amended as: "Without the approval of the Civil Aviation Administration or the local price departments at or above the municipal level, anyone who collects service fees from passengers or shippers or raises the charging standards without authorization shall, in addition to returning the illegally collected fees to the passengers or shippers, be fined 1 10,000 yuan but not more than 200,000 yuan according to the seriousness of the case."
(3) Item (3) of Article 3 is amended as: "Whoever fails to act in accordance with the air transport rules and regulations, neglects his duty or dereliction of duty, and causes a third-class (including third-class) or above transportation accident, in addition to compensating the passengers or shippers according to the regulations, shall be fined according to the accident level: ..."
(4) The term "other airlines" in Item (5) of Article 3 is changed to "airlines".
(5) Item (6) of Article 3 is amended as: "If a passenger or cargo owner complains to the Civil Aviation Administration, the Regional Civil Aviation Administration or other departments that he has been unfairly treated or damaged, the responsible unit shall make an apology after investigation and verification, and impose a fine of not less than 5,000 yuan but not more than 10,000 yuan according to the seriousness of the case." Article 4 Penalty measures
(1) The Civil Aviation Administration authorizes the Regional Civil Aviation Administration to impose penalties on air transport enterprises in the region according to these Interim Provisions.
(two) the Civil Aviation Administration believes that it is a special case and can directly impose penalties.

Item (1) of Article 4 is amended as: "CAAC authorizes regional civil aviation administrations to impose penalties on air transport enterprises that commit illegal acts within their jurisdiction according to these Interim Provisions." Article 5 Sources and uses of fines.
(a) the fine is paid from the reward fund.
(two) the fine shall be deposited in the financial department of the regional civil aviation administration, and the account shall be reported to the regional civil aviation administration for overall arrangement.
(three) the fine as an award fund for advanced units and individuals of air transport enterprises.
