Functions of urban management:

(a) the implementation of urban planning supervision. According to the "People's Republic of China (PRC) City Planning Law" and related laws and regulations, supervise the construction land and construction behavior in the urban planning area;

(two) the implementation of city municipal engineering facilities supervision. According to the "Regulations on Urban Road Management" and relevant laws, regulations and rules, supervise the illegal acts of occupying and excavating urban roads and damaging urban roads, bridges and culverts, drainage facilities and flood control dams;

(three) the implementation of urban public utilities supervision. According to the Regulations on Urban Water Supply and relevant laws, regulations and rules, supervise the illegal acts that endanger and damage urban water supply, gas supply, heating and public transport facilities, and supervise the illegal acts of urban passenger transport operation, gas supply safety, development, utilization and protection of groundwater resources in urban planning areas, and urban water conservation;

(four) the implementation of city appearance and environmental sanitation supervision. According to the "Regulations on the Administration of City Appearance and Environmental Sanitation" and relevant laws, regulations and rules, supervise the illegal acts that damage environmental sanitation facilities and affect city appearance and environmental sanitation;

(five) the implementation of urban landscaping supervision. According to the "Regulations on Urban Greening" and relevant laws, regulations and rules, supervise the illegal acts of destroying urban green space, flowers and trees, landscaping facilities and cutting down trees;

(six) within the scope of entrustment, the implementation of administrative punishment in the name of the entrusted administrative organ.

The main functions of industrial and commercial administration are market supervision and administrative law enforcement. The main responsibilities are as follows:

1. Implement national, provincial and municipal laws, regulations, rules, principles and policies related to industrial and commercial administration, organize and supervise the implementation according to the actual situation in the jurisdiction.

2. Approve the qualifications of various market entities, verify the names of registered entities according to law, approve and issue relevant licenses, and implement supervision and management.

3. Standardize market competition and trading behavior, and investigate and deal with monopoly, unfair competition, pyramid selling and disguised pyramid selling and infringement.

The legitimate rights and interests of consumers and other economic violations that disrupt the order of the socialist market economy; Organize the supervision and administrative law enforcement activities of various markets within the jurisdiction.

4. Supervise and manage all kinds of markets within the jurisdiction, and investigate and deal with violations of market management regulations; Organize and supervise the quality of commodities in the circulation field; In accordance with laws and regulations, we will severely crack down on economic violations such as smuggling and counterfeiting in the circulation field.

5. Supervise and manage economic contracts and other contracts authorized by laws and regulations within the jurisdiction, investigate and deal with cases of illegal activities by using contracts, manage chattel mortgage registration and supervise auctions.

6. Supervise and manage registered trademarks within the jurisdiction, investigate and deal with trademark infringement, protect the exclusive right to use registered trademarks, and supervise and manage trademark printing.

7. Supervise and manage the advertising release and advertising business activities within the jurisdiction, conduct preliminary examination on the advertising business qualifications of enterprises registered within the jurisdiction, and investigate and deal with all kinds of advertising violations within the jurisdiction.

8. Supervise and manage individual industrial and commercial households and private enterprises within their jurisdiction, standardize their production and operation behaviors, and guide their healthy development; Participate in the formulation and planning of policies on the development of individual and private enterprises, and protect the legitimate rights and interests of individual industrial and commercial households and private enterprises.

9. Guide the work of subsidiary bodies and related organizations.

10. To undertake other tasks assigned by the government and higher authorities.

1. The administrative department for industry and commerce is the competent registration authority determined by laws and regulations. Responsible for confirming the legal person qualification or legal operation status of various enterprises, institutions, social organizations and individual citizens (hereinafter referred to as operators, the same below) engaged in commodity production and operation activities, and performing the following registration management duties according to law:

(1) Accepting the application for registration of establishment, change and cancellation of business operators, and examining whether to approve the registration according to the principles and procedures stipulated by laws and regulations;

(2) Supervise the registration behavior and related activities of operators through the annual inspection system;

(three) to investigate and deal with all kinds of violations of the relevant registration regulations;

(four) other duties of registration management as prescribed by laws and regulations.

2, the administrative department for Industry and commerce is the supervision and management organ of market operators trading activities, responsible for investigating the following illegal acts:

(1) unfair competition and illegal monopoly;

(2) Acts that harm consumers' rights and interests;

(3) speculation;

(4) Other illegal market transactions.

3. The administrative department for industry and commerce shall be responsible for the supervision and inspection of contracts and perform the following duties according to law:

(1) Investigate and deal with acts that endanger national interests, social interests and infringe upon the legitimate rights and interests of others by using contracts;

(2) If an enterprise enters into a mortgage contract with movable property (except aircraft, ships and vehicles), it shall be responsible for the registration of movable property mortgage and investigate and deal with violations of the regulations on the registration and management of movable property;

(3) Other contract management responsibilities stipulated by laws and regulations.

4. The State Administration for Industry and Commerce is responsible for the registration and administration of trademarks, and shall perform the following duties according to law:

(1) Accepting the application for trademark registration of business operators and the application for transfer, alteration and renewal of other registered trademarks, and examining and deciding whether to approve the registration according to the principles and procedures stipulated by laws and regulations;

(2) To supervise and manage the use of registered trademarks and make a decision on whether to revoke the registered trademarks;

(3) Accepting the trademark license contract for the record;

(4) Accepting the pledge registration of the exclusive right to use a trademark;

(5) Identification and protection of well-known trademarks;

(6) Handling trademark disputes and making a final ruling or decision on trademark reexamination cases;

(seven) to designate or identify the trademark agency and guide its work;

(eight) other relevant duties as prescribed by laws and regulations.

Items (1) to (3) of the preceding paragraph shall be exercised in the name of the Trademark Office of the State Administration for Industry and Commerce (hereinafter referred to as the Trademark Office); Item (6) shall be exercised in the name of the Trademark Review and Adjudication Board of the State Administration for Industry and Commerce.

Industrial and commercial administrative departments at all levels shall supervise and manage the use of trademarks according to law, and investigate and deal with all kinds of acts that violate the provisions on the administration of trademark use; Protect the exclusive right to use a trademark and investigate and deal with all kinds of violations of the exclusive right to use a trademark.

5. The administrative department for industry and commerce shall supervise and manage all kinds of commodity trading markets and perform the following duties according to law:

(1) Register and count all kinds of commodity trading markets;

(two) regulate and supervise the trading behavior of consumer goods and means of production markets, and investigate and deal with all kinds of violations of relevant market management regulations;

(three) to participate in the supervision and management of finance, labor, real estate, science and technology, information, futures, culture and other markets;

(4) Participate in the cultivation and development of China market system and the demonstration and planning of market layout.

6. The administrative department for industry and commerce shall supervise and manage individual industrial and commercial households, individual partnerships and private enterprises according to law, standardize their business practices, guide their healthy development, and participate in the formulation and planning of policies related to the development of individual and private economy.

7. The administrative department for industry and commerce is the advertising supervision and administration organ, which shall perform the following duties according to law:

(1) Responsible for implementing the advertising business license system, examining and approving advertising business qualifications, and registering outdoor advertisements;

(2) investigate and deal with all kinds of advertising violations;

(three) to formulate and implement the principles, policies and plans for the development of the advertising industry;

(4) to guide the work of advertising censorship agencies and advertising industry organizations.

8. The administrative department for industry and commerce is responsible for guiding the work of the administrative department for industry and commerce, consumer associations, advertising associations, trademark associations, self-employed associations, private enterprise associations and other relevant associations.

9, the administrative department for Industry and commerce to perform the duties of this chapter, laws and regulations, in accordance with its provisions; Where there are no provisions in laws and regulations, it shall be implemented in accordance with relevant national policies, the State Council decisions or industrial and commercial administrative regulations.

10, the State Administration for Industry and Commerce may, in accordance with the provisions of laws and regulations or the instructions of the State Council, formulate rules or issue other normative documents with the same effect according to the needs of actual work, and adjust various social relations within the scope of industrial and commercial administration.
