Chapter 1 General Provisions Article 1 In order to strengthen the management of grain and oil operations and maintain the stability of the grain and oil market, these measures are formulated in accordance with relevant national regulations and in conjunction with the actual situation of this city. Article 2 Grain and oil as mentioned in these Measures refers to raw grain, finished grain, edible oil and edible oil raw materials. Article 3 All enterprises, individual industrial and commercial households and individuals engaged in grain and oil business in this city must abide by these measures. Chapter 2 Grain and Oil Operation and Management Department Article 4 The Municipal Grain and Food Bureau is the competent department for grain and oil operation and management in this city.
The district, county (city) Grain and Food Bureau is responsible for the management of grain and oil operations in the region, and the business is under the guidance of the Municipal Grain and Food Bureau.
Industry and commerce, price, technical supervision and other departments shall, in accordance with their respective responsibilities, coordinate with the grain and oil operations and management departments to do a good job in the supervision and management of grain and oil operations. Article 5 The grain and oil business management department shall inspect the grain and oil market and the business operations of operators, and stop and correct illegal behaviors. When performing their duties, inspectors must produce an inspection certificate issued by the Municipal Grain and Food Bureau.
All enterprises, individual industrial and commercial households and individuals that operate grain and oil must accept inspections from the grain and oil business management department and relevant management departments and obey management. Chapter 3 Business Qualifications and Approval Article 6 Enterprises that operate grain and oil wholesale operations shall meet the following conditions:
(1) Have more than 500,000 yuan of self-owned funds;
( 2) Have business premises and storage facilities commensurate with the business scale;
(3) Have necessary grain and oil quality testing facilities. Article 7 Enterprises, individual industrial and commercial households and individuals that start grain and oil retail operations shall meet the following conditions:
(1) Have more than 10,000 yuan of self-owned funds;
(2) ) has a fixed business outlet or a fixed stall or booth in the market. Article 8 Those who meet the conditions stipulated in Article 6 of these Measures and open a grain and oil wholesale enterprise must submit an application to the grain and oil business management department, and after approval, go to the industrial and commercial administration department for registration.
Units and individuals that start grain and oil retail business should go to the industrial and commercial administration department to register, obtain a business license, and go to the grain and oil business management department to go through the filing procedures.
Farmers selling self-produced grain and oil in the market must hold a resident ID card and a certificate issued by the township government. Article 9 If an enterprise that has obtained a business license needs to add grain and oil wholesale business items, it must go through the change registration procedures in accordance with the provisions of paragraph 1 of Article 8 of these Measures. Article 10 Those who engage in futures trading to obtain grain and oil must obtain a business license in accordance with the provisions of Article 8 of these Measures with the transaction receipt before selling the grain and oil within the contract scope. Chapter 4 Management of Grain and Oil Acquisition and Transactions Article 11 During the period of centralized grain and oil acquisition by the state, the grain and oil market in the acquisition area shall be closed. Except for the grain department that performs the national grain and oil acquisition tasks, no other unit or individual may purchase grain and oil in the acquisition area. .
Grain and oil production units or individuals who have not completed the grain and oil ordering tasks are not allowed to hoard or sell grain and oil themselves. Article 12 The grain department that performs the task of national grain procurement must strictly implement the price and quality standards set by the government, and may not increase or decrease the price and grade of grain purchase without authorization; the payment for grain sales must be cashed in a timely manner, and "IOUs" are strictly prohibited. Article 13 Except for grain enterprises undertaking policy allocation operations, grain and oil transactions between grain and oil wholesale enterprises in this city and the Waifu area must be conducted at the grain wholesale market, and over-the-counter transactions are strictly prohibited.
Waifu grain wholesale enterprises and grain consuming units that come to our city to purchase grain and oil must go to the city’s grain wholesale market to purchase, and over-the-counter transactions are strictly prohibited. Those who do not trade in the city's grain wholesale market will not be allowed to go through railway or road transportation procedures. Article 14 When conducting grain and oil transactions in the grain wholesale market, the buyer and the seller shall each pay a transaction fee of 1.5‰ of the contract amount to the market. Article 15 Grain and oil from other places entering our city must be inspected by the technical supervision department or its recognized quality inspection agency. Those that have not been inspected or failed to pass the inspection are not allowed to enter this city and are not allowed to be sold in the market.
It is strictly prohibited to use contaminated equipment to package grain and oil products. Article 16 Where grains and oils are sold in the market, the varieties, standards and grades of the grains and oils should be marked and the names should be consistent with the actual names. It is strictly prohibited to adulterate grains and oils with fakes, pass fakes as genuine, or pass off substandard goods as good ones. Article 17 Enterprises, individual businesses and individuals dealing in grain and oil must strictly implement the national price policy and the grain and oil prices stipulated by the municipal government, clearly mark the prices, and strictly prohibit price gouging and disguised price increases. Chapter 5 Punishment Article 18 If an enterprise engages in grain and oil business activities without approval, its illegal income shall be confiscated by the industrial and commercial administration department and a fine of not more than 20,000 yuan shall be imposed; if an individual industrial and commercial household engages in grain and oil business without approval, the industrial and commercial administration shall The department will confiscate their illegal gains and impose a fine of less than 500 yuan. Article 19 Anyone who violates the provisions of Article 11 of these Measures shall be forced to purchase the illegally purchased grain and oil by the grain and oil management department in accordance with the minimum protective purchase price stipulated by the state, and shall be fined not more than twice the amount of grain and oil purchased. Article 20 Anyone who violates the price policies of the state and the municipal government and fails to implement clearly marked prices shall be punished in accordance with the national price management regulations and the relevant provisions of the municipal government.
Article 21 Anyone who violates the provisions of Article 16 of these Measures shall be fined by the grain management department not more than one time of the sales volume. Article 22 Anyone who refuses or obstructs the relevant departments of grain and oil management from performing official duties shall be punished by the public security department in accordance with the "Regulations on Public Security Administration Punishments of the People's Republic of China and the State".
