Relevant provisions on punishment:
1. directly and illegally purchasing articles prohibited by the state from smugglers,
Or illegally purchasing other smuggled goods and articles directly from smugglers,
The amount is relatively large;
(2) It is prohibited to enter or leave the country that transports, purchases or sells goods in the inland sea or territorial sea.
Import goods, or transport, purchase or sell goods whose import and export are restricted by the state,
Articles with large amount and no legal evidence;
(3) Transporting overseas solid waste into the country to evade customs supervision.
On February 28th, 2002, the 31st session of the Standing Committee of the Ninth NPC passed the Criminal Law Amendment (IV) of People's Republic of China (PRC).
Article 3 stipulates that Article 155 of the Criminal Law shall be amended as: "The following acts shall be punished as smuggling and punished in accordance with the relevant provisions of this section: (1) illegally purchasing goods prohibited by the state directly from smugglers, or illegally purchasing other smuggled goods and articles directly from smugglers in a relatively large amount; (2) Transporting, purchasing or selling goods that are prohibited from import and export by the state in inland seas, territorial seas, rivers and lakes, or transporting, purchasing or selling goods and articles that are restricted from import and export by the state in a large amount without legal proof. "
Supplement: Smuggling that constitutes the crime of smuggling or is prohibited by other administrative regulations requires the perpetrator to be subjective and intentional, that is, knowing that the goods or articles are smuggled. Subjectively unaware, or used, coerced or deceived by others, does not constitute the crime of smuggling or other crimes of smuggling.
