Legal analysis: the crime of fabricating and deliberately spreading false information is a plot crime, and the act of fabricating and spreading false information must reach the level of seriously disturbing social order before it constitutes a crime. A considerable degree of social harm is the essential feature of crime. "Seriously disturbing social order" can be understood from two aspects: "seriously disturbing" and "social order", and the judgment of both has certain subjective color and abstract elements. Therefore, in judicial practice, in addition to the substantive judgment of social harm, it is also necessary to take the destruction of real public order as the punishment basis for fabricating and deliberately spreading false information. The scope of social order includes the order of public places, public transportation, the work order of state organs, enterprises and institutions, the daily life order of citizens, and the normal work order of functional departments.

Legal basis: the crime of fabricating and spreading false information in securities and futures trading in Article 181 of the Criminal Law of People's Republic of China (PRC). Whoever fabricates and disseminates false information that affects securities and futures trading and disrupts the securities and futures trading market, thus causing serious consequences, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and shall also, or shall only, be fined not less than 10,000 yuan but not more than 100,000 yuan.

Crime of tricking investors into buying and selling securities and futures contracts: employees of stock exchanges, futures exchanges, securities companies and futures brokerage companies, employees of securities associations, futures associations or securities and futures supervision and management departments who intentionally provide false information or forge, alter or destroy trading records to trick investors into buying and selling securities and futures contracts, thus causing serious consequences, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also or shall only be fined not less than 10,000 yuan but not more than 100,000 yuan. If the circumstances are especially bad, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan.

Where a unit commits the crimes mentioned in the preceding two paragraphs, it shall be fined, and the persons who are directly in charge and other persons who are directly responsible shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention.

One of the 291st articles of the Criminal Law of People's Republic of China (PRC) is the crime of releasing false dangerous substances and intentionally spreading false terrorist information. Whoever releases false explosive, toxic, radioactive or infectious disease pathogens, or fabricates terrorist information such as explosion threat, biochemical threat and radiation threat, or spreads it knowing that it is fabricated terrorist information, thus seriously disrupting social order, shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance; If serious consequences are caused, they shall be sentenced to fixed-term imprisonment of not less than five years.

Crime of fabricating and intentionally spreading false information: Whoever fabricates false dangers, epidemic situations, disasters and early warnings and spreads them on information networks or other media, or knowingly and intentionally spreads them on information networks or other media, thus seriously disrupting social order, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance; If serious consequences are caused, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years.
