Where an asset appraisal institution and its asset appraisal professionals are engaged in the business specified in the preceding paragraph, involving the management of other appraisal administrative departments as stipulated by laws, administrative regulations and the State Council, other relevant provisions shall apply. Article 3 For the statutory asset appraisal business (hereinafter referred to as the statutory asset appraisal business) that involves matters such as state-owned assets or public interests within the scope specified in Article 2 of these Measures and needs to be appraised according to laws and administrative regulations, the client shall entrust an asset appraisal institution to conduct appraisal in accordance with the Assets Appraisal Law and relevant laws and administrative regulations. Article 4 The financial department shall implement the principle of combining administrative supervision, industry self-discipline and institutional self-discipline in the supervision and management of the asset appraisal industry. Article 5 The Ministry of Finance shall be responsible for coordinating the supervision and management of the financial departments over the national asset appraisal industry, formulating relevant supervision and management measures and basic standards for asset appraisal, and guiding and urging local financial departments to implement supervision and management.
The Ministry of Finance is responsible for the supervision and management of asset appraisal institutions engaged in securities and futures-related asset appraisal business. Article 6 The financial departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning (hereinafter referred to as provincial financial departments) shall be responsible for the supervision and management of the asset appraisal industry within their respective administrative areas. Article 7 China Asset Appraisal Association shall be responsible for the self-discipline management of the national asset appraisal industry in accordance with laws, administrative regulations, these Measures and its articles of association.
The local asset appraisal association shall be responsible for the self-discipline management of the asset appraisal industry in the region in accordance with laws, regulations, these Measures and the articles of association. Article 8 An asset appraisal institution engaged in asset appraisal business shall not be restricted by administrative regions or industries according to law, except under the circumstances stipulated in Article 16 of these Measures, and no organization or individual may illegally interfere. Chapter II Asset Appraisal Professionals Article 9 Asset appraisal professionals include asset appraisers (including jewelry appraisal majors, the same below) and other asset appraisal practitioners with professional knowledge and practical experience in asset appraisal.
Asset appraiser refers to an asset appraisal professional who has passed the national unified examination for asset appraiser qualification organized and implemented by China Asset Appraisal Association.
Other asset appraisal practitioners engaged in the asset appraisal business stipulated in Article 2 of these Measures shall accept the supervision of the financial department. In addition to engaging in the statutory asset appraisal business, the required professional knowledge and practical experience of asset appraisal shall be independently assessed and determined by the asset appraisal institution.
Appraisers in other professional fields managed by other appraisal administrative departments are engaged in the asset appraisal business as stipulated in Article 2 of these Measures, which shall be implemented in accordance with the provisions of Paragraph 3 of this Article. Article 10 An asset appraisal professional engaged in asset appraisal business shall join an asset appraisal institution and can only engage in business in one asset appraisal institution.
Asset appraisal professionals shall sign labor contracts with asset appraisal institutions, establish social insurance payment relationships, and handle personnel file keeping procedures in accordance with relevant state regulations. Article 11 When engaging in asset appraisal business, asset appraisal professionals shall abide by the provisions of laws, administrative regulations and these Measures, implement asset appraisal standards and various rules and regulations of asset appraisal institutions, and sign asset appraisal reports according to law, and shall not sign asset appraisal reports that have not undertaken business or have major omissions.
A person who has not obtained the qualification of an asset appraiser shall not sign the asset appraisal report of the statutory asset appraisal business, and the asset appraisal report of the statutory asset appraisal business signed by him shall be invalid. Twelfth asset appraisal professionals should accept the self-discipline management of the asset appraisal association and the independent management of the asset appraisal institution, and shall not engage in activities that harm the legitimate interests of the asset appraisal institution.
Asset appraisal professionals who join the Asset Appraisal Association shall enjoy the rights and fulfill the obligations stipulated in the Articles of Association on an equal footing. Chapter III Asset Appraisal Institutions Section 1 Self-management of institutions Article 13 An asset appraisal institution shall take the form of partnership or company according to law, and meet the conditions stipulated in Article 15 of the Asset Appraisal Law.
An asset appraisal institution that does not meet the conditions stipulated in Article 15 of the Asset Appraisal Law may not undertake asset appraisal business. Fourteenth asset appraisal institutions engaged in asset appraisal business, should abide by the asset appraisal standards, perform asset appraisal procedures, strengthen internal audit, and strictly control the risk of practice.
An asset appraisal institution shall designate at least two asset appraisers to undertake the statutory asset appraisal business. An asset appraisal institution that does not have the qualifications of two or more asset appraisers shall not carry out the statutory asset appraisal business. Article 15 The asset appraisal report of the statutory asset appraisal business shall be signed by two or more asset appraisers who undertake the business, and stamped with the seal of the asset appraisal institution after performing the internal procedures, and the asset appraisal institution and the signed asset appraisers shall bear the responsibilities according to law.
