General punishment standard for self-employed: 1. Punishment basis of individual industrial and commercial households: The punishment decision of individual industrial and commercial households is generally administrative punishment. Besides the administrative procedure law and related explanations, we can refer to the relevant provisions of civil litigation. 2. Punishment standards for individual industrial and commercial households: Different illegal acts will have different punishment standards. Taking unlicensed operation as the standard, which does not constitute a criminal offence, shall be punished in accordance with the Measures for the Investigation of Unlicensed Operation. Operating without a license, if there are relevant regulations, will be punished according to the regulations; If there are no relevant regulations, the administrative department for industry and commerce shall order it to stop the illegal act, confiscate the illegal income and impose a fine of 1000 yuan. If it constitutes a criminal offence, it shall be convicted and punished for the crime of illegal business operation.

Legal basis: Article 13 of the Measures for Investigating and Handling Unlicensed Business stipulates that those who engage in unlicensed business shall be punished by the administrative department for industry and commerce in accordance with the provisions of relevant laws and administrative regulations. If the laws and administrative regulations do not clearly stipulate the punishment for operating without a license, the administrative department for industry and commerce shall order it to stop the illegal act, confiscate the illegal income and impose a fine of 1000 yuan.

Article 225 of the Criminal Law of People's Republic of China (PRC) stipulates that anyone who violates state regulations and commits one of the following illegal business operations and disrupts market order, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than one time but not more than five times the illegal income; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than five years, and shall also be fined not less than one time but not more than five times for illegal gains or confiscation of property:

(a) operating a franchise or monopoly commodity or other commodities whose operation is restricted by laws and administrative regulations without permission;

(2) buying and selling import and export licenses, import and export certificates of origin and other business licenses or approval documents stipulated by laws and administrative regulations;

(three) without the approval of the relevant competent departments of the state, illegally engaged in securities, futures, insurance business, or illegally engaged in fund payment and settlement business;

(four) other illegal business activities that seriously disrupt the market order.
