According to the relevant provisions of Order No.8 of the State Development Planning Commission, the Measures for the Implementation of Clearly Marked Prices of Goods and Services in Shanghai have been formulated, which are hereby printed and distributed to you, please follow them. Please implement it in accordance with Order No.8 of the State Development Planning Commission.

Attachment: Measures for the Implementation of Clearly Marked Prices of Goods and Services in Shanghai Article 1 These Measures are formulated in accordance with the Price Law of People's Republic of China (PRC), the Regulations of Shanghai Municipality on Price Management and the Provisions of the State Planning Commission on Clearly Marked Prices of Goods and Services for the purpose of regulating price behavior, maintaining market price order, promoting fair, open and legal market competition and protecting the legitimate rights and interests of consumers and operators.

Article 2 These Measures shall apply to the price behaviors of buying and selling commodities or providing services within the administrative area of this Municipality.

Article 3 The term "clearly marked price" as mentioned in these Measures refers to the behavior of business operators to publicly mark commodity prices, service prices and other relevant information in accordance with the requirements of these Measures when buying and selling commodities and providing services.

Article 4 Business operators shall clearly mark prices, follow the principles of openness, fairness, honesty and credibility, and implement the provisions of pricing laws, regulations, rules and relevant documents.

The prices and charging standards indicated by operators shall be formulated according to factors such as production and operation costs, market supply and demand, etc. Do not deceive consumers with untrue, unfounded or abnormal high and low price tags.

Operators shall not charge more than the marked price for retailing goods or providing services, and shall not charge any unmarked fees, not only without charging or charging less but also charging more.

Article 5 The municipal department in charge of price is the administrative organ of clearly marked price in this Municipality. On the basis of unified organization and implementation by the municipal department in charge of price, the district and county departments in charge of price are responsible for the management of clearly marked price within their respective administrative areas. City and county price supervision and inspection agencies are responsible for the supervision and inspection of the implementation of the price tag.

Article 6 The pricing method of clearly marked price shall be uniformly stipulated by the municipal price department. The city-wide general price tag, industry price tag and characteristic price tag (including price list, the same below) of enterprises operating across districts and counties shall be supervised by the municipal price supervision and inspection institutions, and the regional characteristic price tag shall be supervised by the local district and county price supervision and inspection institutions. Without supervision, no unit or individual may print and sell without authorization.

Article 7 The commodities and services that need to be raised or lowered in price and the items that should not be priced shall be determined by the municipal price department or the district/county price department.

Article 8 The price tag shall be clearly marked, complete, true and clear in content, legible in handwriting, neatly arranged and clearly marked. Price changes should be adjusted in time.

Article 9 All commodity prices and service prices shall indicate the RMB amount in Arabic numerals.

Article 10 Units engaged in foreign-related commodity business and services shall be priced and settled in RMB, and the clearly priced contents of commodities and services shall be marked in Chinese and foreign languages, unless otherwise stipulated by the state. Article 11 The retail price label of a commodity shall indicate the name of the commodity, the place of origin, the pricing unit, the retail price and other main contents. If the specifications, grades, textures and other factors of commodities have an important influence on the formation of commodity prices, they should also be marked.

Article 12 There are three ways to retail commodities: clearly marked price, clearly marked price reduction and clearly negotiated price.

Commodities subject to government pricing and government guidance prices shall be clearly marked. For commodities subject to market-regulated prices, operators can choose pricing methods such as clear price, clear price reduction and clear bargaining.

Article 13 A clearly marked price refers to the price at which a business operator trades with consumers according to the marked retail price. The price shall be clearly marked, and the price reduction shall not be negotiated.

The clearly marked price tag is indicated in blue or green.

Article 14 Price reduction by plain code refers to the transaction price at which an operator sells goods at a price lower than the original sales price. Operators shall truthfully fill in the original price and the reasons for price reduction, and conduct transactions with consumers according to the marked price reduction range. Goods clearly marked shall not be negotiated for price reduction in the transaction.

The original price refers to the price before this price reduction. In addition to fresh goods, the marked original price shall be executed for more than seven days.

If the price is clearly reduced, the operator shall keep the sales invoice stubs and other relevant materials before the price reduction for verification.

The price is clearly marked in yellow.

Fifteenth operators to reduce prices, should indicate the real reason for the price reduction. The reason for the sharp price reduction is:

(1) The shelf life is approaching;

(2) changing seasons;

(3) Inventory backlog;

(four) the suspension of business, business, production;

(5) Defective products and unqualified commodities;

(six) preferential treatment, and shall indicate the period of preferential treatment.

Sixteenth fresh goods near the shelf life of the price reduction, it should be marked in a prominent position the reason for the price reduction and the price reduction range.

If it is sold within four hours, the price reduction or discount rate and the sale period shall be indicated.

Under the above circumstances, the original price tag shall not be replaced.

Seventeenth operators to implement the overall (regional) sales at a reduced price, the operator shall clearly indicate the price reduction period and the price reduction range or discount rate on the basis of the current price. During the price reduction promotion, the original price tag shall not be changed.

Article 18 The clearly marked price refers to the transaction price determined by the operator through consultation with consumers with reference to the marked price. In addition to indicating the reference price, other clearly marked contents shall be implemented in accordance with the provisions of Article 11 of these Measures; The marked reference price shall not be abnormally high. When necessary, the municipal price department shall stipulate the bargaining range for some commodities.

Goods that have been clearly negotiated shall not be reduced in the name of preferential treatment.

The price is clearly marked in red.

Nineteenth markets selling agricultural and sideline products and other commodities, should indicate the name, pricing unit, price, etc. ...

All kinds of commodity trading (wholesale) market according to the provisions of the preceding paragraph.

Twentieth operators engaged in wholesale and retail business, should implement the provisions of the retail price tag.

Twenty-first operators engaged in commodity display and sales (exhibition) business shall implement the provisions of clearly marked prices.

Those who engage in sales business through the internet shall implement the provisions of clearly marked prices.

Article 22 For self-selected goods such as open-shelf counter vending machines and supermarkets, operators shall use a coding machine to paste price labels on the goods or their packages, and clearly mark the prices on the commodity display cabinets (shelves). Supermarkets can use producer price labels representing corporate cultural characteristics to indicate real prices, commodity names, pricing units, retail prices, etc. Goods clearly marked and clearly marked shall still be clearly marked according to the provisions of Articles 14 and 18.

Low-value commodities below 5 yuan, which are centrally placed for retail, can be classified and priced.

Twenty-third sales of drugs should be clearly marked, using the industry price tag; Health products can be clearly marked and clearly reduced in two ways.

Twenty-fourth whoever deals in gold, platinum and jewelry can use the small price tag hung by the industry to indicate the color, weight, pricing unit, processing fee standard, sales price and other contents. At the same time, indicate the price marking method in a conspicuous position on the counter.

Twenty-fifth housing pre-sale, sale and lease shall indicate the benchmark price, increase or decrease coefficient, area and other related matters.

Twenty-sixth operators to buy agricultural and sideline products or waste materials, should be published in a prominent position in the place of purchase price list, indicating the name, specification, grade, pricing unit and purchase price.

The protective price of agricultural and sideline products set by the government shall be publicized in a conspicuous position at the acquisition point. Article 27 A business operator or service provider shall clearly mark the price in a prominent position in the business premises or charging places, and the clearly marked price shall include the service items, service contents, grades or specifications, pricing units, charging standards, etc.

Service charges can be clearly marked according to the characteristics of the industry, using price list, price list, price tag, price tag and other ways.

Twenty-eighth a service consists of multiple standards, the operator shall indicate the sub-items and their charging standards, and shall not mix the price or bundle the services.

Voluntary and optional services and their charges must be marked by service providers or units one by one, and services and their charges shall not be forced or disguised; Shall not be forced or disguised to provide fast and high-quality services and their charges.

Twenty-ninth operators providing catering services shall use the producer price book or special price book to indicate the product name, specifications, pricing unit, sales price and other contents. In addition to fast food, catering operators should issue a settlement list to consumers before settlement.

The name, address and telephone number of the restaurant should be indicated on the title page of the catering price list; The district (county) price supervision and complaint department, address, telephone number and other relevant information that needs to be explained.

Article 30 Operators providing hairdressing, bathing, washing and dyeing and photography services shall use price lists or price manuals to indicate prices. The contents of the price lists include service items, service grades, pricing units and charging standards. ; Those who provide photography services also need to indicate the specifications.

Thirty-first hotels, restaurants and other charging places should publicize the room price, indicating the room type and its price. Business center should indicate service items, pricing units, charging standards, etc.

Article 32 Operators who provide entertainment, fitness and leisure services, such as dance halls, amusement halls and bowling alleys, shall clearly mark their prices in the form of price lists or price tags, indicating the service items, pricing units, charging standards and other related contents.

Thirty-third operators to provide rental services, should be clearly marked, indicating the name, duration, pricing unit, rent, deposit and other contents.

Article 34 Operators who provide maintenance services such as household appliances and daily necessities shall clearly mark the price with price lists or catalogues, indicating the qualification level of the maintenance unit, the name of the maintenance commodity, the maintenance items or parts, the inspection fee standard, the billing unit, the price of spare parts or materials, the exchange price or repair price, the maintenance labor cost, the on-site service fee standard, the overdue storage fee and other contents.

The maintenance price subject to government guidance price shall indicate the intermediate price and its floating range, and use the unified price list (volume) of the industry.

Thirty-fifth operators providing automobile maintenance services should use the price list or the price list to clearly mark the price, and put it in the charging window or hang it in a prominent position in the maintenance site. The price list mainly includes:

(1) Fixed man-hour expenses for maintenance settlement, specifically indicating: maintenance category, maintenance vehicle and vehicle type category, maintenance type, maintenance man-hours, maintenance items, pricing unit, maintenance amount, etc. ;

(two) the cost of repair materials should indicate the name of the assembly system or device, basic parts, main parts and other parts or devices, pricing units and prices. ;

(three) testing and debugging should be marked with testing and debugging items and charging standards.

Article 36 Operators providing transport services shall clearly mark their prices with price lists, price books and price cards, and specific modes of transport may also clearly mark their prices with vouchers.

Thirty-seventh operators who provide vehicle refueling services shall use the price list to publicize in a prominent position in the business premises, indicating the varieties, labels, pricing units, sales prices and other contents.

Thirty-eighth operators who provide parking fee services shall use price tags at the entrances and exits of parking lots for publicity, indicating the charging unit, charging time limit, charging scope, vehicle type, charging unit, charging standard, complaint telephone number and expiration date.

Article 39 Operators providing postal services, express delivery services and telecommunications services shall use price lists or catalogues and charging vouchers, and publicize them in prominent positions at various charging points, indicating service items, charging units and charging standards. The consigned package should also indicate the delivery area, package weight, etc.

Fortieth operators providing property management services shall use the price list and publicize it in the business premises or charging places. Indicate the charging items, charging standards and charging methods. Real estate developers should publicize the charging items and standards determined in advance by the competent price department when selling commercial houses, and clearly stipulate them in the property management contract.

Article 41 Water, electricity, coal and cable TV shall be clearly marked, and the charging date, charging items, consumption quantity, charging amount and other contents shall be indicated on the invoice or charging bill, and publicized in a prominent position in the business or charging place.

Forty-second travel agencies should clearly mark the price by using the price list or price catalogue to publicize or display it in a prominent position in the business premises. Indicate the categories, service contents, service standards, charging items, charging standards, complaint handling institutions and contents that have an important impact on tourism prices.

Forty-third tourist attractions should be clearly marked or clearly marked, and publicized in a prominent position in the business premises or charging places. Indicate the name of the scenic spot, service content, charging standard, joint ticket system or not, price preferential measures, etc.

Article 44 The price list shall be used for clearly marked artistic repertoires, indicating the price, repertoires, performance units, performance sequence, performance time, seat number and other contents.

Article 45 An intermediary service institution shall clearly mark the price with a price list or catalogue, indicating the service unit, service procedures or business rules, service time, place, pricing unit and charging standard.

If the entrustment agreement charges, the entrustment agreement shall include the entrusted matters, the obligations and responsibilities of both parties to the agreement, the charging standard and the payment method.

Forty-sixth medical fees shall be clearly marked, and the charging price list or catalogue or hanging computer or touch computer shall be used for publicity in the eye-catching position of the hospital, indicating the charging items, pricing units and charging standards. The treatment fee must indicate the treatment item, and the material fee must indicate the material specification and brand. Medical expenses should indicate the charging category, name, specification, quantity, pricing unit and retail price of drugs and operations in the computer settlement list.

Forty-seventh education fees should be clearly marked, indicating the charging items, pricing units, charging standards, etc. It should be marked in a prominent position at the charging office or in the enrollment brochure or the notice and bill of charges. Article 48 Where an operator or charging unit violates the provisions of clearly marked prices, the municipal, district and county price departments shall impose administrative penalties according to the Price Law of People's Republic of China (PRC), the Regulations of Shanghai Municipality on Price Management, the Provisions of the State Planning Commission on the Implementation of Clearly Marked Prices for Goods and Services and the Provisions on Administrative Penalties for Price Violations.

Article 49 These Measures shall not apply to interest rates, exchange rates, insurance rates and securities and futures prices, and shall be implemented in accordance with the provisions of relevant laws and administrative regulations.

Article 50 State organs shall, in accordance with the provisions of relevant documents, hang a License for Charging in the charging places and publish detailed charging items and standards one by one.

Fifty-first approach by the municipal price department is responsible for the interpretation of. The municipal price department may formulate detailed rules for the implementation of the industry price tag according to these measures.

Article 52 These Provisions shall come into force as of June 6, 2006. Where the provisions previously issued by our bureau are inconsistent with these measures, these measures shall prevail.
