The constitutive elements of the crime of spreading false information are as follows:

1, object element. The object of the crime of spreading false information is also a complex object, which will not only infringe on the national securities and futures trading management system, disrupt the securities and futures trading market, but also damage the interests of investors;

2. objective factors. The crime of spreading false information is objectively manifested as fabricating and spreading false information that has an impact on securities and futures trading, disrupting the securities and futures trading market and causing serious consequences;

3. Main elements. The subject of the crime of spreading false information is the general subject, including both units and individuals. The latter is a natural person with criminal responsibility at the age of 16;

4. Subjective factors. Subjectively, the crime of spreading false information must be intentional, that is, fabricating and spreading false information will affect the prices of securities and futures trading and disrupt the securities and futures trading markets, but still insist on fabricating and spreading it.

Legal basis: Article 291 of the Criminal Law of People's Republic of China (PRC).

Crime of dropping false dangerous substances; Crime of fabricating and intentionally spreading false terrorist information: Whoever throws false explosive, toxic, radioactive and infectious disease pathogens, or fabricates terrorist information such as explosion threat, biochemical threat and radiation threat, or knowingly spreads fabricated terrorist information, thus seriously disrupting social order, shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance; If serious consequences are caused, they shall be sentenced to fixed-term imprisonment of not less than five years.

Crime of fabricating and intentionally spreading false information: Whoever fabricates false dangers, epidemic situations, disasters and early warnings and spreads them on information networks or other media, or knowingly and intentionally spreads them on information networks or other media, thus seriously disrupting social order, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance; If serious consequences are caused, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years.
