Chapter I General Principles
Article 1 In order to strengthen the management of road transport of dangerous goods and ensure the safety of people's lives and property, these Measures are formulated in accordance with the relevant provisions of the state and combined with the specific conditions of this Municipality.
Article 2 Explosive, flammable, toxic, corrosive, radioactive and other articles. Transportation, loading and unloading, handling, packaging, combined transport services (hereinafter referred to as the transport of dangerous goods) and temporary storage in the process of transportation are easy to cause personal injury and property loss, which need special protection, and belong to the management scope of dangerous goods transportation.
The name of dangerous goods transported by road shall be subject to the Notice of the Ministry of Communications on Issuing the List of Dangerous Goods Carried by Automobile ((9 1) Jiao Yunzhinuo). 163).
Article 3 These Measures shall apply to units engaged in road transport of dangerous goods and units that need road transport in the process of producing, selling and storing dangerous goods within the administrative area of this Municipality.
Drivers, loading and unloading, packaging, storage, escort and management operators engaged in the transport of dangerous goods shall abide by these measures.
Article 4 The Municipal Bureau of Transportation is the administrative department in charge of road transport of dangerous goods, and the specific work is the responsibility of the road transport management institution to which it belongs.
Chapter II Procedures for Examination and Registration of Transport Qualification
Article 5 Units engaged in the transportation of dangerous goods for business shall have specialized transportation conditions such as fixed vehicles, fixed personnel, fixed tasks, fixed protective articles and their cleaning points, and fixed vehicle cleaning and disinfection points. After examination and approval by the public security, transportation and environmental protection departments respectively, it can be transported by the municipal road transport management organ.
To suspend the transport of dangerous goods, a written report shall be submitted to the municipal road transport management institution 30 days ago, and the original license for the transport of dangerous goods shall be cancelled.
Article 6 Enterprises and institutions that bring their own vehicles to engage in the extraction and transportation of dangerous goods of their own units shall submit an application to the municipal road transport management institution with the application form of their own units and the written certificate of the superior safety technology department. Approved by the public security, transportation and environmental protection departments, the municipal road transport management institution shall issue road dangerous goods without a business transport certificate before they can be transported.
Article 7 Where a special parking lot for temporary storage of dangerous goods is set up during the transportation of dangerous goods, it shall submit a written application to the municipal road transport management institution, issue a business license after examination and approval by the public security, transportation and environmental protection departments, and then apply to the administrative department for industry and commerce for a business license. The municipal road transport management institution shall, according to the business license and business license, issue a transit license for road dangerous goods transport before starting business.
To suspend the temporary storage of dangerous goods, a written report shall be submitted to the municipal road transport management institution 30 days ago, and the original transit permit for road transport of dangerous goods shall be cancelled.
Chapter III Consignment
Article 8 The shipper of dangerous goods shall go through the formalities of consigning dangerous goods to the unit with the road dangerous goods transport business license or the dangerous goods transport business acceptance station designated by the municipal road transport management institution.
Ninth consignment of the following dangerous goods, should hold the relevant documents:
(a) explosives, explosives transport certificate issued by the municipal public security organ;
(two) a class of highly toxic substances (that is, drama drugs, strong drugs), there should be a transport certificate of highly toxic substances issued by the municipal public security organ;
(3) Radioactive materials shall be jointly examined and approved by the municipal environmental protection, public security, health and other departments, and they shall hold the Transport Permit for Radioactive Materials issued by the public security organ and the Dose Inspection Certificate for Radioactive Materials or the Inspection Certificate for Radioisotopes and Empty Containers issued by the health department;
(4) For infectious articles, the municipal health and epidemic prevention or veterinary health and quarantine department shall issue the health and quarantine certificate and disinfection certificate;
(5) For narcotic drugs and psychotropic drugs, the shipper shall affix the special seal for narcotic drugs or psychotropic drugs of the health department in the shipper's remarks column of the waybill;
(6) When using containers to transport dangerous goods, in addition to the above certificates, there must also be a certificate of dangerous goods packed in containers issued by the commodity inspection authorities and a certificate issued by the harbour superintendency administration.
If two or more dangerous goods have conflicting properties, they must be checked separately.
Article 10 For the shipment of other dangerous goods that are not listed in the List of Dangerous Goods Carried by Motor Vehicles, it is necessary to hold a dangerous goods identification form uniformly issued by the Ministry of Communications, which shall be examined and signed by the superior competent department and approved by the municipal road transport management institution before going through the transportation formalities.
Article 11 When consigning explosives, category I toxic substances, radioactive substances and dangerous goods requiring special protection, the shipper shall assign a courier who knows the performance of dangerous goods, has emergency experience and is familiar with the business to be responsible for the safety guidance of transportation; Operators of dangerous goods transport shall obey the safety guidance and emergency arrangements of the escorts.
First aid supplies and special protective supplies required by transport operators and vehicles shall be provided by the shipper.
Article 12 The packages and containers of dangerous goods shall conform to the provisions of the Basic Requirements and Performance Tests for the Packaging of Dangerous Goods on Roads and Waterways of the Ministry of Communications, have the specified strength and expansion margin suitable for road transportation, and shall be firm, complete, tight and clean.
Imported dangerous goods with original packaging different from the national standard, which are well packed and meet the requirements of safe transportation, shall be marked with the words "imported original packaging" and transported in the original packaging.
Empty containers of dangerous goods that have not been cleaned and disinfected must be inspected according to the original dangerous goods;
After the empty containers of dangerous goods are cleaned and disinfected, they should be tested by the health and environmental protection departments and issued with quarantine and disinfection certificates before being transported as ordinary goods.
Dangerous goods signs consistent with the nature and classification of internal dangerous goods shall be affixed to the outer surface of the package or the obvious part of the container.
Chapter IV Transportation and Handover
Article 13 When accepting the consignment of dangerous goods, the carrier must check the contents and requirements of the consignment note and the documents provided, check the job site in time and check the packaging situation. If the packaging is damaged or does not meet the packaging requirements, transportation is not allowed.
Article 14 Before shipment, the carrier shall check and verify whether the dangerous goods are in conformity with the name and quantity listed in the waybill and whether the packaging meets the requirements, and sign the waybill to prove that the goods listed in the waybill have been received correctly, and at the same time endorse the loading time.
After the goods are delivered to the destination, the carrier shall notify the consignee for acceptance. After the consignee checks that the parcel is in good condition and the name and quantity are in conformity with the waybill, it shall sign the waybill to prove that the goods have been received and annotate the time of receipt.
Article 15 The carrier shall not deliver dangerous goods to other units for transportation.
Article 16 When the delivered goods arrive at the receiving place, the quantity is short or the packaging is damaged, and both parties shall make records. And signed by the carrier for confirmation. In duplicate, each party holds one copy. The consignee shall not refuse to accept the remaining dangerous goods.
If it is impossible to receive dangerous goods due to damaged packaging, the carrier shall assign special personnel equipped with necessary protective equipment to take care of them; The carrier is responsible for finding the lost dangerous goods and contacting the local authorities in time for handling.
During this period, the carrier shall be responsible for the accident caused by the damaged package.
Chapter V Vehicles and Equipment
Seventeenth vehicles, equipment and tools engaged in road transport of dangerous goods must meet the requirements, and the road transport license shall be stamped on the road transport business license; Non-operating vehicles must hold a non-operating road dangerous goods vehicle transport certificate issued by the municipal road transport management authority.
Eighteenth vehicles engaged in the transport of dangerous goods, driving during the day should be in the left front of the vehicle hanging dangerous goods signal flag; Dangerous goods signs should be installed on the roof when driving at night. Signal flags and lights shall be issued by the municipal road transport management institution in conjunction with the public security organs and installed in accordance with relevant regulations.
Nineteenth vehicles transporting dangerous goods must carry fire-fighting equipment related to the performance of dangerous goods; Vehicles carrying explosives, flammable materials and organic peroxides must have heat insulation and fire extinguishing devices in their exhaust pipes; The tank (box) for transporting flammable liquids must have electrostatic discharge facilities.
Twentieth all kinds of vehicles and buses (including public electricity, cars), are not allowed to transport dangerous goods.
Full-trailer freight trains, three-wheeled motor vehicles, motorcycles, tractors, rickshaws, animal-drawn vehicles and other special vehicles are not allowed to transport explosives, class I oxidants, organic peroxides and other dangerous goods.
Dumpers are only allowed to transport Class II non-flammable solid dangerous goods in bulk.
Chapter VI Transportation and Loading and Unloading
Twenty-first operators engaged in the transport of dangerous goods should participate in the joint training of dangerous goods transport knowledge, technology, business knowledge and emergency handling knowledge organized by the municipal transportation, public security and labor departments. After passing the examination, the traffic, public security and labor departments shall jointly issue the road dangerous goods transport operation certificate before taking up their posts. Relevant personnel engaged in the management of inflammable and explosive chemicals shall also receive professional training on fire control knowledge, and only after passing the examination by the relevant competent departments can they take up their posts to engage in business management.
Twenty-second in the dangerous goods work area, are not allowed to use open flame lighting; No smoking or eating; During loading and unloading operations, unload lightly to prevent rolling and vibration; Operators should obey the command and supervision of the safety management personnel in the operation area.
Twenty-third operators must implement the transportation plan and loading regulations. If the properties of dangerous goods conflict with each other or their fire fighting and protection methods are different, they cannot be shipped in the same car.
Twenty-fourth vehicles, equipment, tools and places contaminated by toxic and corrosive substances and other dangerous goods must be cleaned and disinfected in time and passed the inspection before other goods can be shipped. The residue after cleaning in the carriage should be properly disposed of at the place designated by the environmental protection department.
Special vehicles for transporting dangerous goods are prohibited from transporting edible articles (including feed).
Twenty-fifth operators found that dangerous goods in any of the following circumstances, are not allowed to load:
Dangerous goods transported are inconsistent with the names listed in the consignment note;
(two) the packaging is damaged or does not meet the packaging requirements;
(3) In case of wet and flammable materials, there are traces of water stains and rain;
(four) does not meet the assembly requirements;
(5) The package of dangerous goods is unclear or unmarked.
