2. Article 18 of the National Flag Law stipulates that the national flag and its patterns shall not be used as trademarks and advertisements, and shall not be used for private funeral activities, but there is no stipulation that it shall not be used as social tools. Therefore, it is illegal to use the national flag as an avatar.
3. The use of the national flag pattern should be standardized, and the necessary approval procedures should be fulfilled in advance, but it is not absolutely forbidden to use it in commercial activities. For example, in 2007, the General Office of the State Council sent a letter (Guo Ban Han [2007] No.59), agreeing to use our national flag pattern on licensed goods for the Beijing Olympic Games.
4. Without approval, it is forbidden to use the national flag and its pattern in trademarks and advertisements without authorization. Personal WeChat avatar uses the national flag pattern, which is not expressly prohibited by law. However, if personal WeChat sells goods online, it is prohibited to use it in principle.
5. It shall not be used for private funerals, which is prohibited by law. As long as it is used in a standardized way, it can be used completely.
