Article 2 Adhere to the market as the leading factor, encourage key enterprises with comparative advantages to merge and reorganize difficult enterprises and backward enterprises through strong alliance, brand sharing and integration of production and marketing, promote the concentration of resources to dominant enterprises, promote the development of enterprises to groups, improve industrial concentration and optimize organizational structure; Guide the development of production enterprises and optimize the layout structure; Accelerate the elimination of backward production capacity and promote the adjustment, optimization and upgrading of product structure.
Article 3 Tire manufacturers are encouraged to improve their independent R&D capabilities, increase R&D investment, carry out technological innovation, implement brand strategy, improve product technical level and enhance core competitiveness.
Article 4 Standardize the behaviors of various economic entities in tire production, circulation and consumption, create a fair and unified market environment, establish a tire recall system, and improve the service level of the industry.
Fifth, develop circular economy and improve the level of energy conservation, emission reduction, pollution control and comprehensive utilization of resources; Establish and improve the management system of waste tire recycling, and promote the coordinated development of new tire production, old tire renovation and waste tire recycling.
Chapter II Product Adjustment
Article 6 Encourage the development of safe, energy-saving and environment-friendly high-performance radial tires, giant engineering radial tires, flat passenger radial tires and tubeless radial trucks. Article 8 The development of bias tires shall be strictly restricted, and the production capacity of bias tires shall not be increased except for aviation tires. Eliminate bias tires with an annual output of 500,000 or less and tire production lines with natural cotton cord fabric as the skeleton. Restrict the development of radial truck tire with inner tube.
Chapter III Technology Policy
Article 9 Adhere to the combination of imported technology and independent innovation, track the development of cutting-edge tire technology, encourage original innovation, integrated innovation and introduction, digestion, absorption and re-innovation, continuously develop advanced and applicable technologies with independent intellectual property rights, and promote the industrialization of independent innovation technologies.
Tenth guide and encourage tire production enterprises to strengthen the construction of technology centers, use technology integration and new technology engineering application development, enhance the ability of independent innovation and new product development, and encourage "Industry-University-Research" joint development and commissioned development.
According to the provisions of tax laws and regulations, enterprises can enjoy relevant preferential tax policies for the expenses incurred in developing new technologies, new products and new processes.
Eleventh guide and encourage tire production enterprises to implement the talent strategy, and jointly train and entrust urgently needed technical talents with relevant scientific research institutes and institutions of higher learning; Establish postdoctoral mobile stations, introduce high-level talents and gather intellectual resources.
Article 12 According to the technical development of China tire and tire retreading industry and the development trend of international tire standards, the relevant standards and technical specifications of China tire and tire retreading shall be revised in a timely manner. Guide and encourage the construction of tire performance testing centers, evaluation test sites and engineering technology centers that serve the whole industry.
Thirteenth guide tire enterprises and upstream and downstream enterprises, especially automobile production enterprises to jointly develop new tire varieties.
Fourteenth vigorously promote energy conservation and emission reduction and comprehensive utilization of resources. Guide and encourage tire manufacturers to promote the integration of informationization and industrialization, and carry out technological transformation focusing on increasing varieties, improving quality, saving energy and reducing consumption, reducing emissions and pollution, and ensuring safe production.
Development of rubber, environmental additives and other recyclable raw materials, waste tire recycling technology; Improve and popularize low-temperature rubber mixing and nitrogen-filled vulcanization processes; Strengthen the control of internal mixing dust, rubber mixing and sulfur smoke, and promote clean production technology; Simplify and gradually eliminate tire packaging.
Article 15 Tire enterprises are encouraged to popularize and apply barcode technology, radio frequency identification and other information technologies in tire products and their production processes, build an information integration system covering all aspects of enterprise production, operation and management, and innovate tire product information management and service mode.
Chapter IV Construction of Supporting Conditions
Sixteenth encourage tire enterprises to participate in natural rubber planting and processing, optimize the primary processing of natural rubber, and improve the technology, product quality and logistics service level; Guide enterprises to "go global" and establish overseas natural rubber planting and processing bases.
Improve the natural rubber reserve mechanism, strengthen the construction of natural rubber futures market, and maintain the stable operation of the domestic natural rubber market.
Seventeenth to speed up the development of isoprene rubber, halogenated butyl rubber and other varieties, increase the number of synthetic rubber varieties such as cis-butadiene rubber, styrene-butadiene rubber, and gradually improve the proportion of synthetic rubber and scientific research and production capacity.
Eighteenth actively encourage the development and use of new structural steel cord, high modulus, low shrinkage polyester cord, high strength nylon cord and other tire skeleton materials, accelerate the industrialization and application development of aramid fiber.
Nineteenth to encourage the development of environmentally friendly rubber additives and special carbon black, silica and other raw materials.
Article 20 Encourage the research and development of large-scale and new-type internal mixers, tread rubber extrusion units, steel wire calendering units, wire curtain cutting machines, radial tire molding machinery and semi-finished tire products, product nondestructive testing and online testing equipment, and improve the production equipment and monitoring level.
Chapter V Industry Access
Twenty-first new construction, renovation and expansion of tire production and tire retreading enterprises must conform to the national tire industry development plan and the overall industrial development plan of provinces, autonomous regions and municipalities directly under the central government; It must conform to the environmental protection plan or pollution prevention plan formulated by the state and provincial governments.
Twenty-second in the scenic spots, nature reserves, drinking water source protection areas and residential areas established according to law, no new tire production enterprises, old tire retreading enterprises and waste tire recycling enterprises shall be established. Enterprises that have been put into production in the above-mentioned areas, such as tire production, retreading of used tires, and recycling of used tires, shall gradually withdraw in accordance with the requirements of regional planning through relocation and production conversion.
Twenty-third new construction, renovation and expansion of radial truck tire projects, the annual production capacity should reach more than 6.5438+200 thousand; New construction, reconstruction and expansion of light truck radial tires and passenger car radial tires projects, the annual production capacity should be more than 6 million. The production capacity of the single variety hybrid project of heavy load, light load and car radial tire must also meet the above requirements.
New construction, renovation and expansion of construction machinery tires (except giant construction machinery tires) projects, the annual production capacity should reach more than 30 thousand.
Article 24 Energy-saving and environment-friendly technology and equipment should be selected for new construction, reconstruction and expansion of tire projects, large-capacity closed rubber mixer should be used for rubber mixing, and nitrogen filling process should be adopted for tire vulcanization.
Article 25 The comprehensive energy consumption of new, rebuilt and expanded tire projects shall be less than 950kg standard coal/ton rubber (note: rubber refers to natural rubber, synthetic rubber and reclaimed rubber).
Twenty-sixth new construction, renovation and expansion of tire projects, environmental protection measures should meet the requirements of GB50469, and the reuse rate of enterprise production water should reach more than 90%.
Article 27 Existing tire manufacturing enterprises shall meet the requirements of Articles 24, 25 and 26 before the end of 20 12.
Twenty-eighth used tire retreading enterprises should have the ability to implement the "three guarantees" of products, the tests and tests necessary to ensure the quality of products, the comprehensive utilization of used tires and the realization of solid waste resources.
Enterprises for comprehensive utilization of waste tires should have the ability to realize the recycling of solid waste.
Encourage waste tire retreading enterprises and waste tire comprehensive utilization enterprises to carry out resource comprehensive utilization identification in accordance with the "Administrative Measures for the Identification of Comprehensive Utilization of Resources Encouraged by the State".
Twenty-ninth tire enterprises must pass the quality management system, environmental management system certification and occupational health and safety management system certification.
Article 30 Tire production enterprises that meet the requirements of Article 23, Article 24, Article 25, Article 26 and Article 27 can enter the market only if they meet the technical specifications and implement the "three guarantees" service.
Tire products that must be subject to compulsory certification according to regulations must pass compulsory certification before they can be sold.
The tires of three-wheeled vehicles and low-speed trucks (including agricultural tires) shall conform to the corresponding technical specifications, and the special tires for three-wheeled vehicles and low-speed trucks must be obviously different from other tires.
Thirty-first institutions engaged in tire testing and certification shall carry out their work in strict accordance with the relevant provisions of the state and be responsible for the results of testing and certification. Testing institutions and certification bodies shall not repeat testing and charging for the same product. If the interests of consumers and producers are damaged due to work mistakes, they shall bear corresponding responsibilities according to relevant laws and regulations. Institutions that fail to pass the examination according to the relevant provisions of the state shall be disqualified in time.
Article 32 Those engaged in the scientific research and production of military tires shall be included in the license management of scientific research and production of weapons and equipment according to the relevant provisions of the state.
Thirty-third motorcycle tires, power tires industry access conditions, used tire renovation and waste tire recycling industry access conditions will be formulated in due course.
Chapter VI Investment Management
Article 34 According to the Decision of the State Council on the Reform of Investment System and the Interim Administrative Measures for the Approval of Foreign-invested Projects, the domestic tire construction projects shall be put on record and the foreign tire projects shall be approved.
Article 35 In order to actively respond to the changes in the tire development environment, during the planning period of industrial adjustment and revitalization (2009-20 1 1 year), no new tire projects will be built or expanded except for the relocation and technical transformation of existing enterprises (including mergers and acquisitions).
Thirty-sixth domestic enterprises to invest in new construction, renovation and expansion of tire projects (including mergers and acquisitions in different places and the construction of non-independent legal person branches in different places) shall be filed by the relevant departments confirmed by the provincial people's government.
Encourage powerful domestic enterprises to set up tire factories overseas, and domestic enterprises to invest in overseas tire production projects shall be handled in accordance with relevant state regulations.
Thirty-seventh foreign investment in new construction, renovation and expansion of tire projects, with a total investment of less than 300 million US dollars, shall be approved by the relevant departments confirmed by the provincial people's government; Projects with a total investment of more than $300 million shall be submitted to the competent state department for examination and approval by the relevant departments confirmed by the provincial people's government.
Chapter VII Import and Export Administration
Article 38 Give full play to the role of tax rate in regulating industrial development, scientifically formulate tax items and tax rates for tire products and raw materials for tire production, and coordinate the development of tire industry and related industries.
Article 39 Under the guidance of the relevant state departments, establish and improve the early warning system of industrial damage in the tire industry to safeguard the safety of China's tire industry.
Fortieth export tires must be purchased from enterprises that meet the industry access conditions of this policy, and the products must meet the standards of our country; If the importing country requires higher standards, it must also meet the standards of the importing country.
Article 41 Imported tires must meet the relevant national standards and management regulations of China.
Chapter VIII Brands and Services
Forty-second tire production enterprises must use legal trademarks, and it is strictly forbidden to produce jerry-built tires, modified tires and fake and shoddy tires.
Article 43 Guide and encourage tire enterprises to formulate brand cultivation plans and implement brand management strategies. Develop own brand products, maintain independent brand image, improve brand awareness and reputation, and constantly enhance brand value.
Forty-fourth encourage tire manufacturers and brand marketers to establish long-term and stable cooperative relations, and promote the construction of brand product sales and service system.
Article 45 Tire production enterprises are encouraged to establish strategic cooperative relations with automobile production enterprises and tire marketers, innovate service concepts and change tire management methods.
Foreign investors are allowed to set up enterprises engaged in tire sales and after-sales service in accordance with the laws and administrative regulations of China.
Article 46 It is prohibited to sell smuggled tires, unqualified tires, cut tires, modified tires, and truck tires and passenger car tires without compulsory product certification marks; It is strictly forbidden to distribute tires without three guarantees.
Forty-seventh guide tire production enterprises to cooperate with marketing enterprises, large transportation groups, and comprehensive utilization enterprises of waste tires to establish tire marketing models such as retreading and replacing old tires.
Article 48 Establish a tire recall system (including retreading tires). The recall system is implemented from the tires of Ml models (passenger cars with no more than 9 seats, including the driver's seat) and gradually implemented in all tire products.
Article 49 It is strictly forbidden to provide tire products to overloaded vehicles that attempt to illegally produce or modify them.
Fiftieth advocate tire consumers to use brand products and consciously regulate their use behavior; In order to maintain traffic safety, it is forbidden to use tires that have reached the wear limit.
Chapter IX Recycling of Waste Tires
Fifty-first establish and improve the management system of waste tire recycling, and standardize the construction of waste tire recycling market system.
Fifty-second guide and encourage tire production enterprises to develop circular economy, develop old tire renovation and waste tire recycling technology, and participate in the construction of waste tire recycling system.
Scientifically and reasonably improve the retreading rate and times of truck tires, bias tires and aviation tires, and extend the whole life mileage of tires; The newly designed and manufactured tire products should be retreatable, and the design and manufacture of new tires should gradually improve the retreatability and retreading times; Refurbished tires should be treated as new tires, and a compulsory certification system should be implemented according to regulations. Before retreaded tires enter the market, products that need compulsory certification must first pass certification.
Fifty-third enterprises engaged in the renovation and reuse of used tires must adopt clean production technologies and equipment that meet the requirements of environmental protection, energy conservation and emission reduction, and put an end to secondary pollution. It is strictly forbidden to use waste tires for indigenous oil refining, and the established indigenous oil refining devices using waste tires shall be banned according to law.
Fifty-fourth enterprises engaged in the recycling of waste tires, the source of waste tires should be mainly domestic. In order to prevent foreign pollution from transferring to China, the import of waste tires should be strictly implemented in accordance with relevant national laws and regulations to prevent illegal import of waste tires in disguise.
Chapter 10 Others
Article 55 Actively play the role of intermediary organizations such as trade associations as a bridge and link between the government and enterprises, strengthen industry self-discipline, standardize industry operation, maintain industry order, monitor industry operation, strengthen industry services, carry out industry exchanges, and promote the healthy development of the industry.
Promote trade associations to establish dialogue, consultation and information exchange mechanisms with foreign trade associations and industries, strengthen communication, build mutual trust, enhance cooperation and resolve trade frictions.
Article 56 If the standards and technical specifications involved in this industrial policy are revised, the revised standards shall prevail.
Article 57 This industrial policy shall be implemented as of the date of promulgation, and the Ministry of Industry and Information Technology shall be responsible for the interpretation and timely revision according to the industrial development.
