Article 1: In order to speed up the cultivation and improvement of the socialist market system, promote the healthy development of various commodity trading markets, and maintain normal circulation order, these Measures are formulated in accordance with relevant national and provincial regulations. Article 2 The term "market" as mentioned in these Measures includes consumer goods markets, production means markets, production factor markets, and cultural and other special markets that have fixed trading venues and facilities, are attended by a number of operators, and are publicly traded. Article 3 All enterprises, institutions, social groups and individuals that open markets within the province must implement these measures.

This method does not apply to the registration management of futures trading markets. Article 4: Industrial and commercial administrative agencies at all levels are responsible for registering various markets and supervising and managing them in accordance with the law. Article 5 Before opening a market, enterprises, institutions, social groups and individuals (hereinafter collectively referred to as market-opening units) shall, in accordance with relevant national and provincial regulations, obtain approval from the people's government at or above the county (city, district) level or their authorized departments, and go to the industrial and commercial administration. The regulatory authority applies for market registration. If a market is jointly opened, all parties to the joint operation shall jointly apply or entrust one of the parties to apply for registration. Article 6 The opening of a market shall meet the following conditions:

(1) The opening unit complies with the provisions of Article 5 of these Measures;

(2) It has the corresponding venues and facilities;

(3) The commodities listed for trading comply with relevant national regulations;

(4) There are corresponding management agencies and management personnel;

(5) National and provincial regulations Other conditions. Article 7 When a market opening unit applies for market registration, it shall submit the following documents and certificates:

(1) Market opening application report;

(2) Market opening feasibility study report;

(3) Approval document from the county (city, district) people’s government or its authorized department;

(4) Approval of ownership, use certificate or road occupation of land, houses, etc. Documents;

(5) If a market is jointly opened, an agreement signed by all parties to the joint operation shall be submitted;

(6) Regulations of the national and provincial industrial and commercial administration agencies other relevant documents and certificates. Article 8 Market registration includes the following matters:

(1) Market name, category, address, floor area and main facilities;

(2) Types of commodities sold;

(3) Founding unit and person in charge;

(4) Market construction investment amount;

(5) Other matters stipulated by the national and provincial industrial and commercial administration authorities. Article 9 Market units must implement the following provisions:

(1) Consciously abide by relevant laws, regulations, rules and policies;

(2) Obey the supervision of market registration management agencies Management, and assist the market registration and management authority in reviewing the qualifications of the entry business entities to ensure the legality of the business entities;

(3) In accordance with the regulations of the market registration and management authority, promptly go to the market registration and management authority for annual inspections ;

(4) Establish an internal market management organization to undertake the daily management of the market;

(5) Establish an effective system to ensure fair transactions;

(6) ) Establish fire prevention, anti-theft, sanitation, public security and other systems, and equip full-time personnel and related equipment to ensure market safety and stability;

(7) Establish a market statistics system and regularly submit various types of reports to the market registration management agency Commodity transaction volume, transaction value, stalls and other data;

(8) Provide storage, communication, information consultation and other services to operators entering the venue. Article 10 Market openings shall be registered in accordance with the following principles:

(1) Markets approved by the Provincial People’s Government or its authorized departments shall be approved and registered by the Provincial Administration for Industry and Commerce;

(2) Markets approved to be opened by the Municipal People’s Government (including the Administrative Office) or its authorized departments and the Municipal District People’s Government or its authorized departments shall be approved and registered by the Municipal (Administrative Office) Industrial and Commercial Administration;

(3) Markets approved to be opened by the county (city) people's government or its authorized departments shall be approved and registered by the county (city) industrial and commercial administration authority. Article 11 When a market unit applies for registration, the industrial and commercial administrative authority shall make a decision on whether to approve or disapprove registration within 30 days from the date of acceptance. If the registration is approved, a "Market Registration Certificate" printed uniformly by the national industrial and commercial administration authority will be issued; if the registration is not approved, the applicant unit will be notified in writing. Article 12 If a market is relocated, expanded, rebuilt, merged, or divided, and the main registration items are changed or canceled for any reason, the opening unit shall go to the original market registration management authority in advance to handle the change or deregistration. Article 13 When a market unit sets up a business service agency in the market, it shall, after completing the market registration, apply for the registration of the business service agency in accordance with the "Regulations of the People's Republic of China on the Registration and Management of Enterprise Legal Persons".

The day-to-day management of the market by a market unit should be strictly separated from the business service agencies and business service activities it has set up. Article 14 If an enterprise legal person unit opens a market individually or jointly, in addition to market registration, it must also handle change registration in accordance with the "Regulations of the People's Republic of China on the Registration and Administration of Enterprise Legal Persons". Article 15 A market operator may engrave an official seal and open a bank account based on the market registration certificate.

Article 16 A market unit that violates the following provisions shall be punished by the industrial and commercial administrative authorities:

(1) If a market is built without completing the registration procedures, it shall be ordered to stop the construction, complete the registration procedures within a time limit, or be banned. A fine of not less than RMB 2,000 but not more than RMB 10,000 shall be imposed;

(2) Anyone who starts business without going through the registration formalities shall have his illegal gains confiscated, be ordered to stop operating, complete the registration formalities within a time limit or be banned, and shall be fined RMB 2,000 A fine of not less than 10,000 yuan but not more than 10,000 yuan; (3) Violating the provisions of Article 12, the person shall be ordered to go through the procedures for change or cancellation of registration within a time limit, and shall be fined not less than 1,000 yuan but not more than 5,000 yuan.
