Article 1 These detailed rules are formulated in accordance with the "Regulations on Clearly Marking Prices for Goods and Services" (hereinafter referred to as the "Regulations").

Article 2 "Enterprises" as mentioned in Article 2 of the "Regulations" include:

(1) State-owned, collective, and private enterprises engaged in production and operation in mainland China;

(2) Foreign-invested enterprises and foreign enterprises that have established production and business institutions and sites in mainland China;

(3) Hong Kong, Macao and Taiwan-invested enterprises in mainland China .

In Article 2 of the "Regulations", "charges collected" include operating charges and administrative charges.

Article 3. Goods and services priced by the state must be priced strictly in accordance with national regulations; prices of goods and services with national guidance prices should be strictly controlled within the prescribed range; prices should be liberalized Goods and services are independently priced and publicly priced based on market supply and demand.

Article 4 The competent authorities that supervise and inspect the implementation of clearly marked prices for goods and services are price inspection agencies at all levels.

Article 5: Clear pricing of goods and services shall be done through price tags, price lists, price boards, price tags, price books (books), price lists and other pricing methods (hereinafter referred to as "price tags or price lists") ). In addition to the specific pricing method and content being implemented in accordance with the relevant provisions of these detailed rules, the price inspection agencies of provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning or their authorized prefecture (city) and county-level price inspection agencies may combine the actual conditions of the region and the differences of various industries. Article 6 Price tags or price lists should disclose product prices or charging standards in the form of "display type", "display type", "hanging type", etc. based on the characteristics of the industry and the actual situation of the department.

Article 7 Price labels or price lists shall be uniformly supervised by price inspection agencies at or above the county level. If it is necessary to produce special price tags due to the characteristics of the industry, they must be approved and supervised by the price inspection agency at or above the county level. No unit or individual may print without authorization.

Article 8: To implement a clearly marked price system, prices must be complete, accurate, clear in writing, well-aligned with product labels, and eye-catching. When prices change, they must be replaced in a timely manner.

Article 9 When selling or purchasing goods with different names or the same name, if any of the following conditions apply, one goods, one signature must be implemented:

(2) Different specifications;

(3) Different grades;

(4) Different materials;

(5) Different colors ;

(6) Different packaging;

(7) Different trademarks.

Article 10 The RMB amount stated on the price tag or price list must be expressed in yuan, jiao, or cents. The unit of price tags or price lists for large-scale transactions may be "10,000 yuan".

Article 11 All shops, merchandise counters, foreign-related restaurants, hotels, guesthouses, travel agencies, etc. that specialize in foreign-related goods must indicate prices or charging standards in Chinese and foreign languages ??on their price tags or price lists respectively.

Article 12 In ethnic autonomous areas, Chinese characters and common ethnic minority characters may be used to indicate prices or charging standards.

Article 13 The settlement shall be based on the actual transaction price, and the specific payment items and prices shall be listed. If you consume first and settle later, you must issue a settlement receipt.

Article 14 For those engaged in retail business, commodity price tags should include main contents such as product name, origin, specification, grade, pricing unit, retail price, etc. The price tag shall be approved by a full-time and part-time price clerk or a designated person. signature.

Article 15 If a coding machine is used to affix price labels on commodities or their packaging at open-shelf counters or self-selected (supermarkets), they must also press the labels on the cabinets (shelf) where the commodities are displayed by category. Article 16 The original and current price of goods that are subject to price reduction must be publicly marked to distinguish them from the normal commodity prices.

Article 17 If it is necessary to reduce the content of price tags due to industry characteristics or if certain special commodities (such as art treasures, antiques, etc.) are not suitable for price tags, they must be approved by the local price authority.

Article 18 "Engaged in wholesale business" in Article 5 of the "Regulations" includes:

(1) Purchasing or selling goods at normal prices;

Those engaged in wholesale business must indicate the product name, origin, grade, pricing unit, wholesale price, etc. on the sales invoice and price tag or price list.

Article 19 Any unit or individual that charges fees must publish a detailed price list of charging items at the location or business premises where fees are required to be paid. The price list should include the name of the charging items, Main content such as grade or specification, service content, pricing unit, charging standard, etc.

Article 20: Units and individuals that use venues, museums, houses, buildings, public facilities and other places to provide paid services (temporarily) shall indicate in the price list the method, facilities, and Area, time (period) and other service items or scope.

Article 21 Those who purchase agricultural and sideline products or waste materials must publish a purchase price list at the purchase point, indicating the product name, specification, grade, pricing unit, purchase price, etc.

Article 22 If the price authority stipulates a price limit for the purchase of agricultural and sideline products, the purchase department shall announce it in a conspicuous position at the purchase point.

Article 23 Commodities entering the production means trading market should be marked with product name, place of origin, specifications, model (brand) number, pricing unit and sales price.

Article 24 Agricultural and sideline products and industrial consumer goods entering the wholesale market should also be clearly priced, and the price tags should indicate the product name, origin, specification, grade, pricing unit and sales price.

Article 25 Houses and real estate entering the real estate trading market should indicate their location, structure, specifications, area, pricing unit, and sales (rental) price.

Article 26 Where it is not appropriate to use price tags or price list codes to mark prices (such as futures markets, stock markets, etc.), prices or charging standards can be disclosed in the form of quotation display (demonstration) boards and other forms.

Article 27 If the price authority stipulates a price limit or reference price for commodities entering the production materials trading market, the market management department shall announce it in a conspicuous position.

Article 28 The clear price marking method for agricultural and sideline products and other commodities entered into urban and rural fair markets and operated by mobile stalls may be uniformly stipulated by the market management department. The price tag or price list (board) should indicate the product name. , pricing unit, sales price and other main contents.

Article 29 Railway, transportation and other departments that sell goods or charge fees in restaurants, dining cars, kiosks and mobile vending trucks serving cars, ships, docks (stations) shall refer to this article Article 28 of the detailed rules shall implement clear price marking.

Article 30: If the price authority stipulates a reference price or temporary sales price limit for consumer goods and agricultural and sideline products, the market management department shall announce it in a conspicuous position.

Article 31 If the price is not clearly marked in accordance with these detailed rules, the price inspection agency may, depending on the severity of the case, impose criticism and education, issue a warning, make corrections within a time limit, order the illegal gains to be returned to the purchaser or user, Illegal gains may be confiscated, fined, or named in a public manner.

Article 32: For units or individuals who commit any of the following acts, the price inspection agency has the right to impose the following penalties, which may be imposed individually or concurrently. The maximum amount of penalty shall not exceed 10,000 yuan.

(1) Anyone who does not fill in the price tag according to the prescribed content will be fined 3 yuan for each tag.

(2) If some goods or charges are not clearly marked, a fine of 5 yuan will be imposed for each missing label (item), and the total amount of fines shall not exceed 2,000 yuan.

(3) If all goods or charges are not clearly priced, a fine of not more than 8,000 yuan will be imposed.

(4) Anyone who fails to place (hang) price tags or price lists as required will be fined 3 yuan for each tag (item).

(5) For those who are indeed first-time offenders and the circumstances are minor and they take the initiative to correct themselves after inspection, they may be dealt with lightly.

(6) Any illegal income that is not settled in accordance with the clearly marked price and exceeds the marked price shall be returned to the consumer. If it cannot be returned, it shall be confiscated by the price inspection agency and a fine of not more than 5,000 yuan shall be imposed.

(7) Any party who commits fraud by using price tags or price lists may be fined not more than 10,000 yuan.

(8) Anyone who refuses to accept supervision and inspection or commits fraud during the inspection shall, in addition to being ordered to accept inspection and provide the true situation, be fined not more than 10,000 yuan and be named in a public way.

(9) Anyone who prints or uses price labels or price lists without the consent of the price inspection agency shall be fined not more than 5,000 yuan, and his or her self-made price labels or price lists shall be confiscated.

(10) The directly responsible person and the person in charge of a unit that fails to implement clearly marked prices in accordance with regulations may be fined 50 yuan to 500 yuan respectively.

The above penalties include the original amount.

Article 33 If an individual business owner or itinerant vendor violates the relevant provisions of these rules and refuses to make corrections after being educated and refuses to pay fines and confiscations, items equivalent to the fines and confiscations may be confiscated and sold to offset the fines.

Article 34: After the price inspection agency makes a penalty decision on a unit or individual that has committed the above-mentioned illegal acts, if the party fails to apply for reconsideration within the time limit and fails to pay the fine or forfeiture, it may notify the bank to transfer it.

Article 35 If the punished unit or individual is dissatisfied with the penalty decision of the price inspection agency, it may apply for reconsideration to the higher-level price inspection agency within 15 days from the date of receipt of the penalty notice. The price inspection agency at the next higher level shall make a reconsideration decision within 30 days from the date of receipt of the reconsideration application. The execution of the original penalty decision will not be suspended during the period of reconsideration. If the review applicant is dissatisfied with the review decision, he may file a lawsuit with the People's Court within 15 days from the date of receipt of the review decision.

Article 36: In addition to complying with the provisions of Article 17 of these Detailed Rules, administrative charging units shall also hang a charging license issued by the competent price department at the charging place, and implement a bright certificate (with a certificate) )TOLL. If there are multiple charging places, copies of the charging license should be hung everywhere.

Article 37 The State Planning Commission is responsible for the interpretation of these rules.

Article 38 These rules shall come into effect on the date of promulgation.
