Legal basis: Article 33 of the Regulations on Safety Management of Hazardous Chemicals. The state implements a licensing system for the operation of dangerous chemicals (including warehousing operations, the same below). Without permission, no unit or individual may deal in dangerous chemicals. A legally established hazardous chemicals production enterprise does not need to obtain a hazardous chemicals business license to sell hazardous chemicals produced by the enterprise in its factory area. According to the provisions of the People's Republic of China (PRC) Port Law, a port operator who has obtained a port operation license can engage in hazardous chemicals storage operations in the port area without obtaining a hazardous chemicals operation license.
