Legal basis: Article 3 of the Customs Law of the People's Republic of China * * * If the consignee of imported goods fails to declare to the customs for more than three months from the date of declaration of the means of transport, the imported goods shall be extracted by the customs and sold in accordance with the law. If there is any surplus from the proceeds after deducting transportation, loading and unloading, storage and other expenses and taxes, it shall be returned upon the application of the consignee within one year from the date of legal sale of the goods; Among them, if the country has restrictive regulations on import and should submit the license but cannot provide it, it will not be returned. If no one applies or refuses to return it within the time limit, it shall be turned over to the state treasury.

Upon the examination and approval of the customs, the person in charge of the original means of transport or the consignee or consignor of the goods shall go through the formalities of returning or importing the imported goods within three months from the date of unloading the means of transport; When necessary, it may be extended for three months with the approval of the customs. Failing to go through the formalities within the time limit, the customs shall handle it according to the provisions of the preceding paragraph.

if the goods listed in the preceding two paragraphs are not suitable for long-term storage, the customs may handle them in advance according to the actual situation.

The imported goods declared by the consignee or the owner of the goods to be abandoned shall be collected by the customs and sold according to law; After deducting transportation, loading and unloading, storage and other expenses, the proceeds will be turned over to the state treasury.
