Trial regulations on the administration of quality license for export mechanical and electrical products
Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of strengthening the quality management of export mechanical and electrical products, enhancing the reputation and competitiveness of China's mechanical and electrical products in the international market, and expanding export to earn foreign exchange. Article 2 These Measures shall apply to the key export mechanical and electrical products produced by national factories. The specific product catalogue shall be issued separately by the State Import and Export Commodity Inspection Bureau in conjunction with the centralized department of mechanical and electrical products. When a production enterprise is approved to obtain a quality license for the export of a certain variety of mechanical and electrical products (hereinafter referred to as the quality license), it only shows that the product has the quality conditions for export. Article 3 The State Administration for Import and Export Commodity Inspection (hereinafter referred to as the State Commodity Inspection Bureau) and the relevant centralized departments of mechanical and electrical products shall be fully responsible for the leadership of the implementation of quality licenses and the organization and coordination of relevant units, formulate assessment methods for issuing quality licenses, identify testing units, and examine and approve the issuance and cancellation of quality licenses. Article 4 All products subject to quality license must obtain quality license within the prescribed time limit before export, and products without quality license shall not be exported. Under special circumstances, the export must be approved by the State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products. Chapter II Conditions for a factory to obtain a quality license Article 5 A factory that produces mechanical and electrical products for export must meet the following conditions:

(a) complete, unified and correct product drawings, technical conditions and inspection procedures;

(2) Having production equipment, process equipment and measuring instruments, testing equipment and test equipment to ensure the quality of products, spare parts and raw materials;

(3) Having a team of professional technicians, skilled workers and metrological inspectors who can guarantee the quality and normal production of products, and being able to conduct production, testing and inspection in strict accordance with the drawing process and technical standards;

(4) An effective quality assurance system has been established for the products for which the quality license is applied;

(five) the establishment of a civilized production management and assessment system, and can balance production and complete export tasks on schedule. Article 6 The quality of exported mechanical and electrical products must conform to the current international general technical standards, and the items not specified in the international standards should conform to the national standards and the standards (professional standards) of the relevant departments in charge of mechanical and electrical products. If there is no such standard, it should be implemented according to the enterprise standard approved by the relevant competent department (bureau), and meet the requirements of the first-class products in the current Product Quality Classification Regulations issued by the relevant centralized department of mechanical and electrical products.

If foreign customers have specific requirements, the product technical conditions specified in the contract signed between the enterprise and the customer shall be used as the inspection basis for export products.

For products and non-standard products that have been exported for many years and have stable quality and are well received by foreign countries, but are temporarily unable or unsuitable to implement the above quality standards, enterprises should formulate technical conditions for export products, which will be implemented as transitional standards after being approved by the State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products. Article 7 The packaging of exported mechanical and electrical products shall meet the requirements of the Ministry of Foreign Trade and Economic Cooperation, the State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products. Chapter III Testing Units Article 8 Testing units shall be impartial and relatively independent. The State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products jointly evaluate, approve and formally authorize the issuance of approval certificates and special seals for quality licenses. The quality inspection of export products of inspection units is subject to the supervision and guidance of the State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products. The testing unit is responsible for product testing and factory review in the certification work. For serious mistakes in work, the State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products may revoke their accreditation certificates and special seals for quality licenses. Article 9 The testing unit is responsible for testing the products, reviewing the production conditions of the factory, signing opinions on whether to issue or revoke the quality license, and issuing or revoking the quality license and issuing a notice of non-conformity after being examined and approved by the superior. Article 10 The testing unit shall be responsible for drawing up the detailed rules for the implementation of quality licenses for various types of export mechanical and electrical products, which shall be officially promulgated and implemented after being approved by the State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products. Eleventh inspection units should follow the principle of non-profit and economy when issuing quality licenses, and charge the inspected units according to the actual labor services and consumption expenditures. The testing unit shall formulate specific charging standards according to the charging methods formulated by the centralized department of mechanical and electrical products, and report them to the State Commodity Inspection Bureau and the centralized department of mechanical and electrical products for approval and implementation. Twelfth testing units should keep the technology and test results of products confidential and protect the legitimate rights and interests of the tested units. Chapter IV Application and Certification Procedures Article 13 Before exporting products with quality licenses, production enterprises must apply for quality licenses one by one within the application period. The application procedure manufacturer shall receive the application from the local commodity inspection bureau. After examination by the competent product departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government and the local commodity inspection bureau, it shall be sent to the relevant testing units.

After receiving the application, the testing unit is responsible for reviewing the production conditions of the factory and sampling the products. If the products meet the requirements specified in Chapter II after inspection, they shall sign the examination opinions, submit them to the State Commodity Inspection Bureau and the relevant centralized departments of mechanical and electrical products for examination and approval, and then issue quality licenses. The inspection of quality license should be connected with the production license, acceptance of international standards, product quality rating and other work, and the items with the same content generally do not repeat the inspection within the validity period. Article 14 When the product structure, process, formula, production conditions and technical standards that have obtained the quality license have undergone major changes, a new application must be made. If new products need to be exported, they should be applied according to the Measures for the Administration of New Products after trial production, identification and finalization and stable production.
