Regulations of Hunan Province on Property Management of Urban Residential Areas
Chapter I General Provisions Article 1 In order to standardize the property management of urban residential areas, protect the legitimate rights and interests of owners, users and property management enterprises, and create and maintain a safe, clean, civilized and comfortable living environment, these Regulations are formulated in accordance with relevant national laws and regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to the property management and related activities in relatively concentrated residential areas within the urban planning area of this province.

The term "property management" as mentioned in these Regulations refers to the activities that the property management enterprise accepts the entrustment of the owner to repair, maintain and manage the * * used parts, * * used equipment and corresponding supporting * * used facilities in the property management area and provide related services in accordance with the contract. Article 3 The real estate administrative departments of the people's governments at or above the county level shall strengthen the supervision and management of property management within their respective administrative areas. Chapter II Owners' Organizations Article 4 Property management areas shall be designated by the real estate administrative departments of the people's governments at or above the county level in conjunction with relevant units according to the use of residential facilities.

All owners in the property management area form the owners' meeting; If there are a large number of owners, the owners' representatives can be elected in proportion to form the owners' meeting. The owners' congress or the owners' congress (hereinafter referred to as the owners' congress) shall elect the owners' committee.

The owners' association is an organization that represents and safeguards the legitimate rights and interests of all owners in property management activities, and the owners' committee is the office of the owners' association. Article 5 The owners' association shall perform the following duties:

(a) to formulate the articles of association of owners and the owners' convention;

(two) to elect and recall members of the owners' committee and supervise the work of the owners' committee;

(three) to review the draft property management service contract;

(four) authorize the owners' committee to sign, modify or terminate the property management service contract with the property management enterprise;

(five) to examine and approve the budget, final accounts and updating methods of the property maintenance fund;

(six) to decide on other major matters of property management. Article 6 The owners' convention and the resolutions adopted by the owners' association are binding on all owners in the property management area. The civil liability of the owners' association shall be borne by all owners. Article 7 The discussion methods and voting procedures of the owners' congress shall be stipulated in the articles of association of the owners' congress. The owners' association shall carry out activities in accordance with these regulations and the articles of association of the owners' association. The list of owners' committee and its members shall be reported to the local real estate administrative department of the people's government at the county level for the record within 30 days from the date of election. Article 9 The owners' committee shall perform the following duties:

(1) Organizing the owners' meeting;

(two) according to the written authorization of the owners' association, the property management enterprise is selected through bidding, and the property management service contract is signed, modified or terminated with the property management enterprise;

(three) to supervise the use of property maintenance funds;

(four) to listen to and reflect the opinions and suggestions of the owners and users on property management services;

(five) to urge the owners and users to abide by the owners' convention and perform the property management service contract;

(six) other duties entrusted by the owners' association. Tenth owners in the property management activities, in accordance with the provisions of the owners' convention and the property management service contract to exercise their rights and fulfill their obligations.

The user is authorized by the owner in writing to exercise rights and perform corresponding obligations on behalf of the owner within the scope of authorization. Chapter III Property Management Enterprises Article 11 An enterprise engaged in property management shall, within 30 days from the date of obtaining the business license, submit a copy of the business license and articles of association to the real estate administrative department of the people's government at the county level where the enterprise is located for the record. Twelfth property management enterprises shall enjoy the following rights:

(a) according to the laws and regulations and the property management service contract, formulate the property management system;

(two) according to the property management service contract to collect property management service fees;

(three) choose a franchise enterprise to undertake special business services;

(four) to stop the violation of the property management system;

(5) Other rights stipulated by laws and regulations.

The property management system formulated by the property management enterprise shall be examined and approved by the owners' meeting. Thirteenth property management companies shall perform the following obligations:

(a) to perform the property management service contract and provide property management services;

(two) accept the supervision of the owners, users and owners' committee;

(three) accept the supervision and management of the relevant administrative departments of the people's governments at or above the county level where their business activities are located;

(4) Other obligations stipulated by laws and regulations. Chapter IV Property Management Services Article 14 Before the houses in the property management area start to be sold and the owners' committee is established, the property sales unit shall select property management enterprises to undertake the preliminary property management. The property management enterprise shall sign the preliminary property management service agreement with the owner.

For unsold houses in the property management area, the property management service fee shall be borne by the property selling unit. Fifteenth property sales units shall provide property management services in accordance with the total construction area of the house from three thousandths to five thousandths, and the expenses shall be included in the development and construction costs, and the ownership shall be owned by all owners. Sixteenth property sales units shall, within fifteen days from the date of the establishment of the owners' committee, hand over the following property information to the owners' committee:

(a) completion site plan, single building, structure, equipment completion drawings, facilities completion drawings and other completion acceptance data;

(2) Technical data on installation, use and maintenance of facilities and equipment;

(three) property quality assurance documents and property use documents;

(four) other information required for property management.
