Regulations of Xuzhou Municipality on Dam Management
Article 1 These Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC), the Flood Control Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this Municipality, in order to strengthen the management of dams, give full play to the engineering benefits of dams and ensure the safety of people's lives and property. Article 2 Dams mentioned in these Regulations include dikes of rivers and lakes, reservoir dams and their supporting projects. Article 3 These Regulations shall apply to dams managed by cities and counties (cities, districts) within the administrative area of this Municipality. Fourth city and county (city, district) people's government water administrative departments in accordance with the provisions of the authority responsible for the management of dams within their respective administrative areas. Dam management agencies at all levels are entrusted by the water administrative department to implement daily dam management. Article 5 Dam management shall be carried out in accordance with the principle of unified regional management and hierarchical management, and the management at lower levels shall be subordinate to the management at higher levels.

Dams managed by the state and the province within the administrative area of this Municipality shall be managed in accordance with the relevant provisions of the state and the province.

The Beijing-Hangzhou Canal, Xuhonghe River (including Fangting River), the old course of the Yellow River, Jizheng River (below Fan Lou and Houge Station), Wan Ding River embankment, yunlong lake Reservoir Dam and other unstable river sections are managed by the municipal water administrative department.

Dams other than those specified in the preceding two paragraphs shall be managed by the water administrative department of the county (city, district) where they are located.

Dams managed by higher water administrative departments may be entrusted to lower water administrative departments for management. Article 6 The management scope of the following river embankments is:

(a) twenty meters outside the unstable reach of the Beijing-Hangzhou Canal, the floodplain of Xu Hong and Ji Zheng, and the backwater slope toe of the dike;

(2) Ten meters away from the toe of the backwater slope of the floodplain and dike in Wan Ding;

(3) Old course of the Yellow River:

1. Ten meters outside the foot of water shadow slope and backwater slope in Fengxian section;

2. 30 meters outside the toe of Tongshan County, Suining County, Ying and Beishui Slope, and 30 meters outside the toe of the backwater slope of the levee;

3. Twenty meters outside the backwater slope toe of Hong Zhong levee, east of beijing-shanghai railway and west of the Third Ring Road.

The management scope of urban river dikes shall not be less than five meters outside the backwater slope toe.

The scope of management of river embankments other than those specified in the preceding two paragraphs shall be delineated by the local county (city, district) people's government according to the actual situation. Article 7 The management scope of the following reservoir dams is:

(1) Twenty meters outside the backwater slope of yunlong lake Reservoir Area and Beigoukou Dam;

(two) fifty meters outside the reservoir area of Cuihezhuang Reservoir and the water slope at the back of dam toe (drainage ditch with intercepting ditch);

(3) One hundred and twenty meters outside the backwater slope toe of Ahu Reservoir and the dam;

(4) One hundred and ninety-five meters outside the reservoir area of Gaotang Reservoir and the backwater slope toe of the dam;

(5) The outer mouth of the intercepting ditch outside the Qing 'an Reservoir area and the small weir at the foot of the dam back water slope.

The management scope of reservoir dams other than those specified in the preceding paragraph shall be delineated by the local county (city, district) people's government according to the actual situation.

The reservoir area is determined according to the designed maximum flood level line. Water administrative departments at all levels shall establish and improve dam management institutions according to management needs, and clarify specific management responsibilities.

The daily maintenance of the dam can be contracted in sections, and the responsibility lies with people. Article 9 Before and after the flood season every year, people's governments at all levels shall organize relevant departments to conduct safety inspections on dams within their jurisdiction. For dams that have been destroyed, fail to meet the design flood standards or have serious quality defects, relevant units shall be organized in time to take reinforcement measures to eliminate the danger within a time limit. Tenth major floods, heavy rains, heavy rains, strong earthquakes, or abnormal use of the project, major accidents, etc. occurred in this area and surrounding areas. The water administrative department shall conduct a special inspection of the dam. Eleventh when the dam collapses or may collapse at any time, the local people's government has the right to call materials, equipment, means of transportation and manpower within its jurisdiction to carry out emergency rescue.

Materials, equipment and means of transport that meet the requirements of the preceding paragraph shall be returned in time after being rescued; If it cannot be returned or causes losses, it shall be compensated in accordance with relevant state regulations.

If it is necessary to occupy land or temporarily occupy land for dam maintenance and reinforcement due to emergency, relevant procedures can be handled according to law after occupation. Twelfth units and individuals engaged in production and operation within the scope of dam management shall obey the safety supervision and management of the water administrative department and shall not endanger the safety of the dam. Thirteenth river embankments should be equipped with water and soil conservation projects such as bolin, dike forest belt, slope protection turf, drainage ditch, water retaining weir and falling water; The reservoir dam should be planted with turf, not with cuttings.

Dams with poor soil quality, dams that may cause floods, and dams in important areas should be protected with stones and concrete. Fourteenth no unit or individual may cut down trees within the scope of dam management without authorization. If logging is really necessary, it shall be approved by the water administrative department before it can apply for a cutting license according to law and complete the specified task of renewal and replanting.

Dam management institutions shall be exempted from afforestation funds in accordance with the relevant provisions of the state for tending and updating dikes and revetment trees and for flood control and emergency rescue.
