Opinions on Several Issues Concerning the Transfer and Continuation of the Basic Endowment Insurance Relationship for Urban Enterprise Employees

In order to implement the Notice of the General Office of the State Council on Forwarding the Interim Measures for the Transfer and Continuation of the Basic Endowment Insurance Relationship for Urban Enterprise Employees of the Ministry of Human Resources and Social Security (hereinafter referred to as the Interim Measures), according to the situation reflected by various localities, The following suggestions are put forward on the relevant issues in the specific implementation:

1. Unifying and standardizing the transfer of funds

In order to better unify and standardize the standards for the transfer of funds, when transferring the overall fund (unit payment), I will transfer it uniformly according to the sum of 12% of my actual payment salary for each year after January 1, 1998; When transferring the storage amount of personal account, before January 1, 1998, it will be transferred according to the accumulated principal and interest of individual contributions; during the period from January 1, 1998 to December 31, 25, it will be transferred according to the total storage amount (including principal and interest, the same below) of individual contributions, and after January 1, 26, it will be transferred according to the total storage amount of individual contributions.

II. Determination of the payment wage index

When the insured who has transferred and continued the basic old-age insurance relationship across provinces according to the provisions of the Interim Measures meet the conditions for receiving benefits and approved the basic old-age insurance benefits, the payment wage index is determined by the following methods: calculate my payment wage index based on my payment wage in each participating place and the average salary of employees in each receiving place, and then calculate my indexed average payment wage and basic pension.

III. Handling of Multiple Old-age Insurance Relationships

If the insured person is employed and has basic old-age insurance relationships in more than two places at the same time, when handling the transfer and continuation of the basic old-age insurance relationship, the social insurance agency will negotiate with me to determine to keep one of the basic old-age insurance relationships and personal accounts, and other relationships will be cleaned up during the same period, and the amount of personal account storage will be returned to him, and the corresponding personal payment period will not be counted repeatedly.

Before the implementation of the Interim Measures, the insured who has repeatedly received the basic pension will be determined by the social insurance agency through consultation with himself to keep one of the basic old-age insurance relationships and continue to receive benefits. Other old-age insurance relationships should be cleaned up, and the rest of his personal account will be returned to him in one lump sum, and the basic pension he has received will not be repaid.

IV. Handling the problem of arrears of insured persons

If the insured person owes the basic old-age insurance premium before transferring and continuing the basic old-age insurance relationship, I will pay the personal arrears to the place where the original old-age insurance relationship is located before going through the formalities of transferring and continuing the basic old-age insurance relationship. At the same time, the social insurance agency at the place where the original insured person is located is responsible for transferring out the unit payment part including the year when the insured person originally owed; If I don't pay my personal arrears, the social insurance agency should also go through the formalities of the basic old-age insurance relationship and fund transfer in time. The payment period will not be calculated for the time when I owe the basic old-age insurance premium, and the fund will not be transferred for the time when I owe the personal arrears, and then I will no longer pay the arrears.

V. Repatriation of Personal Accounts

If the insured person goes abroad to settle down or settle in Hongkong, Macao and Taiwan Province, he shall go through the formalities of terminating the basic old-age insurance relationship according to the relevant provisions of the state, and return the stored amount of personal accounts in full. article 1 in order to standardize the procedures for handling the transfer and continuation of basic old-age insurance for employees in urban enterprises, these procedures are formulated in accordance with the interim measures for the transfer and continuation of basic old-age insurance for employees in urban enterprises (hereinafter referred to as the interim measures).

article 2 these procedures are applicable to the business handling of transferring and continuing the basic old-age insurance relationship between people (including migrant workers) participating in the basic old-age insurance across provinces, autonomous regions and municipalities directly under the central government (hereinafter referred to as "inter-provinces").

article 3 Ministry of Human Resources and Social Security shall establish a national basic old-age insurance relationship transfer information system. Where the social insurance agencies in the transfer-in and transfer-out places (hereinafter referred to as "social insurance agencies") have been networked with the system, information exchange on the transfer of basic old-age insurance relations will be carried out through the system (specific rules will be stipulated separately). For paper transfer, in order to facilitate timely formalities, relevant materials can be sent by fax first, but at the same time, official letters, forms and other materials still need to be mailed by letter.

article 4 before the insured person moves across provinces, the employer or the insured person shall apply to the social security institution where the basic old-age insurance relationship is located (hereinafter referred to as the original insured place) to issue the basic old-age insurance payment voucher (annex 1, hereinafter referred to as the payment voucher), and provide the insured person's resident identity card and other relevant supporting materials as required. After checking the payment information with the insured unit or insured person, the social security institution of the original insured place will issue the "Certificate of Insurance Payment" and inform the transfer and connection conditions. For the insured with arrears, inform them of the arrears and remind them to pay them in time.

Article 5 Migrant workers across provinces who meet one of the following conditions may apply for the transfer and continuation of the basic old-age insurance relationship:

1. Men under 5 years old and women under 4 years old;

2. returning to the place where the household registration is located for employment and insurance;

3. The employee is transferred with the approval of the organization department of the Party committee at or above the county level and the administrative department of human resources and social security, and has established labor relations with the transferred unit and paid the basic old-age insurance premium;

4. when the conditions for receiving benefits are met, the basic old-age insurance relationship is not in the place where the household registration is located, and the cumulative payment period in the place where the basic old-age insurance relationship is located is less than 1 years, and the basic old-age insurance relationship is transferred back to the original insured place where the previous payment period is over 1 years, or transferred to the place where the household registration is located because the insurance period is not over 1 years.

article 6 after the insured person is employed by floating across provinces, the basic old-age insurance relationship shall be established in the new employment place according to the regulations. The employer or insured person in the new employment place applies to the social security agency in the new employment place for transfer and continuation, presents the Insurance Payment Certificate, and fills in the Application Form for Transfer and Continuation of Basic Endowment Insurance Relationship (Annex 2, hereinafter referred to as the Application Form). If the insured fails to issue the "Certificate of Payment for Insurance" when he leaves the original place of insurance, the social security institution of the new place of insurance can contact the social security institution of the original place of insurance to reissue it.

article 7 the social security institution of the new employment place accepts the application form and relevant materials and examines them. Article 8 The social security institution of the original insured place shall complete the following procedures within 15 working days from the date of receiving the Contact Letter:

1. Check the relevant information and generate the Information Form for the Transfer and Continuation of the Basic Endowment Insurance Relationship (Annex 4, hereinafter referred to as the Information Form);

2. Go through the fund transfer procedures;

3. Send the Information Form to the social security institution of the new employment place;

4. terminate the local basic endowment insurance relationship of the insured.

article 9 after the social security institution of the original insured place has transferred the relevant information of the insured person, it is still necessary to keep the information for backup.

Article 1 The social security institution of the new employment place shall complete the following procedures within 15 working days after receiving the Information Form and the transfer fund:

1. Check the Information Form and the amount of the transfer fund;

2. record the transfer fund amount into the overall fund and the personal account of the insured person respectively according to the regulations;

3. according to the information form and the materials provided by the employer or the insured, supplement and improve the relevant information;

4. notify the employer or the insured of the completion.

Article 11 For migrant workers across provinces who need to set up temporary basic old-age insurance payment accounts (hereinafter referred to as "temporary payment accounts") according to the provisions of Article 5 of the Interim Measures, the social security agency in the new place of employment shall inform them in writing of the reasons and policy basis for not being able to handle the transfer of basic old-age insurance relations, set up temporary payment accounts for them within 15 working days, and issue the Notice on Setting up Temporary Basic Old-age Insurance Payment Accounts to the social security agency in the original place of insurance participation (Annex 5, hereinafter). After receiving the "Notice", the social security agency of the original insured place will establish a special logo for the insured.

article 12 if an insured person who has established a temporary payment account is employed across provinces again or reaches the retirement age stipulated by the state, he/she shall go through the relevant procedures for transferring the temporary payment account to the original place of insurance or the place where he/she receives benefits.

Article 13 When a person who establishes a temporary payment account handles account transfer, the employing unit or the insured person applies for transfer to the social security agency in the place where the temporary payment account is established (hereinafter referred to as the "temporary account establishment place") and fills in the Application Form for Transfer of Payment Account of Temporary Basic Endowment Insurance (Annex 6).

Article 14 If the social security agency in the place where the temporary account is established accepts the application for transfer and finds it correct, it shall send the Contact Letter for Transfer of Payment Account of Temporary Basic Endowment Insurance (Annex 7, hereinafter referred to as the Contact Letter for Transfer of Temporary Account) to the social security agency in the original insured place or the place where the benefits are received within 15 working days from the date of acceptance.

the social security agency of the original insured place or the place where the benefits are received shall, within 15 working days after receiving the Contact Letter for Temporary Account Transfer, send the receipt of the Contact Letter for Temporary Account Transfer to the social security agency of the place where the account is temporarily established.

Article 15 The social security agency in the place where the account is temporarily established shall, after receiving the receipt of the Contact Letter for Temporary Account Transfer, go through the relevant transfer-out procedures in accordance with Article 8 of these Rules, and terminate the local temporary payment account of the insured, but still need to keep the relevant information for backup.

Article 16 The social security institution of the original insured place or the place where the benefits are received shall complete the connection procedures within 15 working days after receiving the Information Form and the transfer fund, and record the amount of the transfer fund into the overall fund and the personal account of the insured person respectively according to the regulations.

article 17 if a person who has established a temporary payment account goes abroad to settle down or dies on the job, he or his agent (hereinafter referred to as the "applicant") shall go through the formalities of receiving the personal account of the temporary payment account in one lump sum.

the social security agency in the temporary account establishment area accepts the relevant information submitted by the applicant and reviews it.
