The People's Government of Jiangsu Province attaches great importance to the preparatory work for the implementation of the social relief fund for road traffic accidents, organizes relevant departments to carefully plan the preparatory work for the implementation of the relief fund, and creates conditions to promote the smooth implementation of the relief fund in Jiangsu Province as soon as possible, so as to truly do a good job of benefiting the country and the people. With the consent of the provincial people's government, the general office of the provincial government officially forwarded the "Implementation Measures for the Management of Social Assistance Fund for Road Traffic Accidents in Jiangsu Province" (hereinafter referred to as the "Management Measures") formulated by the Provincial Department of Finance, Jiangsu Insurance Regulatory Bureau and other six bureaus, which shall come into force as of the date of promulgation.
The social relief fund for road traffic accidents (hereinafter referred to as the relief fund) refers to the social special fund raised according to law to pay for funeral expenses, part or all of the rescue expenses and help families with special difficulties caused by traffic accidents. When the traffic accident victims, their close relatives and the compensation obligor are unable to pay or exceed the payment standard of the accident vehicle underwriting insurance company, the rescue fund shall advance the rescue expenses and funeral expenses in advance, and after the rescue fund advances, they shall claim compensation from the person responsible for the motor vehicle road traffic accident according to law. The relevant units, the victims or their heirs have the obligation to assist the relief fund in recovery. The relief object of the relief fund refers to the victims caused by motor vehicle road traffic accidents except the insured vehicle personnel and the insured.
The promotion scope of the rescue fund
According to the provisions of the "Management Measures", under any of the following circumstances, the funeral expenses and part or all of the rescue expenses of the victims of road traffic accidents shall be paid in advance by the rescue fund, and the rescue fund management institution shall have the right to recover from the person responsible for road traffic accidents:
(a) the cost of rescue exceeds the limit of compulsory insurance liability;
(two) the motor vehicle did not participate in compulsory insurance;
(3) A motor vehicle escapes after an accident;
(four) other circumstances that need assistance, including the inability of the responsible person in traffic accident compensation to compensate, which causes difficulties for the victim's family and really needs assistance. If a traffic accident victim needs a relief fund to pay part or all of the relief expenses, the traffic administrative department of the public security organ shall notify the relief fund manager in writing within three working days, and the traffic accident victim or his close relatives shall submit a relief application to the relief fund manager's acceptance outlet at the place where the accident occurred in time with relevant certification materials. If the identity of the victim cannot be determined or the victim and his close relatives cannot apply for assistance, and the medical institution or funeral institution has paid the medical rescue expenses or the funeral expenses for death, the medical institution or funeral institution may apply for assistance on its behalf. After receiving the application and related materials, the relief fund manager shall, within five working days, review the application according to the relevant provisions of these Measures, the guidelines for clinical diagnosis and treatment of road traffic accident victims and the charging standards formulated by the local price department. In line with the first payment or relief conditions, the relief fund manager will transfer the relevant expenses to the account of the medical funeral institution. Do not meet the conditions for advance payment or assistance, not to advance assistance, and explain the reasons to the applicant.
Sources of bailout funds
According to the Administrative Measures, the sources of relief funds include:
1, pay compulsory insurance premium for motor vehicle traffic accident liability according to a certain proportion;
2. The government gives financial subsidies according to the amount of business tax paid by insurance companies;
(3) The owner or manager of the motor vehicle fails to handle the fine of compulsory insurance in accordance with the provisions;

7. Social donation;
8. Other funds.
Management of rescue fund
The relief fund shall be accounted for separately, managed in special accounts and used in accordance with the prescribed purposes. The Provincial Department of Finance, jointly with the Jiangsu Insurance Regulatory Bureau, determines the specific extraction ratio of the province at the beginning of each year according to the proportion range of the year's compulsory insurance premium extraction rescue fund determined by the Ministry of Finance and the China Insurance Regulatory Commission and the income and expenditure of the last year's rescue fund, in accordance with the principle of balance of payments.
At the same time, the Provincial Department of Finance will allocate financial subsidies to the provincial rescue fund according to the current budget, the amount of business tax paid by insurance companies in the last quarter and the income and expenditure of the rescue fund. The financial departments at all levels shall regularly transfer the fines that are not covered by compulsory insurance to the special account of the provincial relief fund.
Jiangsu Road Relief Fund implements a management system of unified policy, unified management, professional organization operation and division of responsibilities among departments. The provincial government has specially set up the "Jiangsu Social Assistance Fund Management Coordination Group" (hereinafter referred to as the Provincial Assistance Fund Coordination Group), which is responsible for guiding, supervising and inspecting the collection, use and management of assistance funds. After repeated argumentation, the relief fund coordination group decided to hire Zijin Property Insurance Co., Ltd., the first national property insurance company headquartered in Jiangsu Province, as the relief fund manager, specifically responsible for the application, advance payment, review and fund disbursement of the relief fund.
