What is a housing maintenance fund?
Housing maintenance fund actually includes housing public facilities special fund and housing maintenance fund. In 2007, according to the order 165 jointly issued by the Ministry of Construction and the Ministry of Finance at that time, it was finally the "special housing maintenance fund".
How to calculate the housing maintenance fund
1. According to the relevant regulations on house purchase and sale, the calculation formula of house maintenance fund is: construction area per square meter × proportion× area. The ratio is multi-layered: the buyer pays 1.5% and the seller pays 6%; Senior management: the buyer pays 1.5% and the seller pays12%;
The scheme of 2.200 1 stipulates: buyer: construction area per square meter 18 yuan (same for many high-rise buildings); Seller: The building area per square meter of multi-storey building is 7 1.88 yuan, and the building area per square meter of high-rise building is 143.76 yuan.
Conditions that must be met when using the housing maintenance fund
1, the special maintenance funds are fully collected in place, and the maintenance projects are in line with the scope of maintenance funds;
2, public parts, public facilities and equipment warranty expires;
3, involving the property management area or all the owners, has been agreed in writing by the owners' meeting, and the exclusive part accounts for more than 2/3 of the total construction area and accounts for more than 2/3 of the total number of owners.
How to pay the housing maintenance fund
When selling commercial housing, the purchaser and the selling unit shall sign the relevant maintenance fund payment agreement, and the purchaser shall pay the maintenance fund to the selling unit according to the proportion of 2-3% of the purchase price. The maintenance fund collected by the selling unit belongs to all owners and is not included in the residential sales income. The current deposit standards of the first special maintenance fund are: 90 yuan per square meter for high-rise buildings (including multi-storey buildings with elevators) and 50 yuan per square meter for multi-storey buildings (including villas).
Housing maintenance fund management department
Under normal circumstances, the housing maintenance fund is managed by the real estate administrative department. After the establishment of the owners' committee, the public maintenance fund will be handed over to the industry committee, which will exercise the management right.
Procedures for using the maintenance fund:
(1) Before the maintenance funds are transferred to the owners' congress for management, the following procedures shall be followed if special maintenance funds for houses are needed:
First, the property service enterprises put forward suggestions for use according to the maintenance, renewal and transformation projects; If there is no property service enterprise, the relevant owners will put forward suggestions for use;
B Proprietary parts account for more than two-thirds of the total construction area and account for more than two-thirds of the total number of people within the scope of residential special maintenance funds.
(three) the realty service enterprise or the relevant owners organize the implementation of the use plan;
(four) the realty service enterprise or related industries shall hold relevant materials and apply for fees to the competent construction department of the local city or county people's government;
E, after the approval of the competent department of construction, to the special account management bank issued a notice of transfer of residential special maintenance funds;
F, special account management bank will be required for residential special maintenance funds allocated to the maintenance unit.
(2) After the maintenance funds are handed over to the owners' congress for management, the application formalities shall be handled:
(a) the realty service enterprise puts forward the use plan, which shall include the maintenance, renewal and transformation projects, the cost budget, the scope of expenses, the emergency that endangers the safety of the house and other countermeasures for the temporary use of special maintenance funds for the house;
B the owners' congress adopts the use plan according to law;
C property services companies organize the implementation of the use plan;
D, the realty service enterprise shall submit the residential special maintenance funds and related materials to the owners' committee;
E. The owners' committee shall examine and approve the use plan and report it to the competent construction department for the record; If the competent construction department finds that it does not conform to the relevant laws, regulations, rules and use plans, it shall be ordered to make corrections;
F, the owners' committee issued a notice of transfer of residential special maintenance funds to the special account management bank;
G special account management bank will allocate the required residential special maintenance funds to the maintenance unit. In addition, the maintenance fund is raised by the property owner, who enjoys the ownership of the maintenance fund according to the proportion of payment, but the right to use it belongs to all owners, and individual owners are not allowed to withdraw all their own maintenance funds from the bank. The maintenance fund is combined with a specific house, exists with the existence of the house, and is also lost with the existence of the house, and does not change because of the change of the specific owner. When the house property right is changed to a new owner, the maintenance fund should also be renamed from the old owner to the new owner.
