The donated funds can be used according to the designated purpose of the donor. If there is no designated purpose, the Foundation will use the funds in the most needed projects according to the actual situation.

Use of donated property: 1. Public welfare social organizations should use the donated property to fund activities and undertakings that conform to their purposes. The purposes of public welfare social organizations include two aspects: (1) Legal purposes. Social organizations must abide by the Constitution, laws, regulations and national policies, and must not oppose the basic principles determined by the Constitution, nor endanger national unity, security and national unity. It shall not harm the interests of the state, the interests of the public and the legitimate interests of other organizations and citizens, and shall not violate social morality. The purpose of the Foundation's activities is to promote the development of scientific research, culture and education, social welfare and other public welfare undertakings through financial support.

(2) The purpose stipulated in the articles of association, because the forms of public welfare social organizations are diverse, their specific purposes are also different, so public welfare social organizations should also clarify their purposes in their articles of association.

2. Regarding the use of donated property for disaster relief, disaster relief donation is a special donation, which refers to the act of donating property to help individuals or groups who are in trouble and unable to save themselves due to natural disasters such as earthquakes, floods and fires. China has a vast territory, and natural disasters often occur, and some natural disasters have caused great losses and extensive social influence. Therefore, this article has made special provisions on disaster relief donations, which must be used for special purposes. Anyone who misappropriates disaster relief donations shall be punished in accordance with the provisions of Chapter V of this Law.

3. The proportion of funds used by the Foundation to support public welfare undertakings every year. The purpose of the Foundation's activities is to promote the development of scientific research, culture and education, social welfare and other public welfare undertakings through financial support. Supporting public welfare undertakings is the end result of the use of the Foundation's property. If the funds are not used for public welfare undertakings, the Foundation will have no meaning of existence. Because the Foundation has to maintain long-term operation and the projects funded each year are different, The foundation also needs to preserve and increase the value of donated property and ensure a certain risk fund. Therefore, the foundation can reserve some funds for the principal of the fund every year. In order to prevent the foundation from making profits in the name of public welfare and non-profit, this article stipulates that the foundation must have a certain proportion of funds to fund public welfare undertakings every year, but this article does not specify the minimum proportion, and the minimum proportion is stipulated by the State Council.
