Legal analysis: For general disasters, the government has no subsidy policy. When a major natural disaster occurs, the Ministry of Agriculture and the municipal finance will give appropriate disaster relief funds to farmers, agricultural professional cooperatives and agricultural enterprises according to the disaster situation and the affected area. In the case of natural disasters, farmers can buy agricultural insurance if they want to get compensation. Of course, agricultural insurance can only get corresponding compensation if it reaches the loss level stipulated in the clause.

Legal basis: Interim Measures of the Central Government for the Administration of Subsidies for the Prevention and Control of Crop Diseases and Pests.

Article 9 The Ministry of Agriculture shall, according to the monitoring and forecasting results of crop diseases and insect pests and the actual occurrence of diseases and insect pests in various places, review the application reports of provinces (autonomous regions and municipalities), put forward suggestions on the allocation of subsidies from the central government in that year, and submit them to the Ministry of Finance. After the audit by the Ministry of Finance, the funds will be allocated to the provincial finance department.

Tenth provincial agricultural (animal husbandry) departments and financial departments shall formulate implementation plans according to the scale of central financial subsidies. The contents of the implementation plan include: the occurrence and harm of crop diseases and insect pests, the development of prevention and control work, the implementation of local funds and the allocation and use plan of central financial subsidy funds.

Eleventh pesticides and equipment needed to prevent and control crop diseases and insect pests, in addition to emergency relief, should be unified by the provincial agricultural (animal husbandry) departments and financial departments to implement government procurement.

Article 12 Departments and units that manage and use subsidies for the prevention and control of plant diseases and insect pests shall establish a detailed account of subsidies for the prevention and control of crop diseases and insect pests in the central finance, earnestly strengthen the supervision and management of subsidies for the prevention and control of plant diseases and insect pests, and take the initiative to check the arrangement and use of subsidies in conjunction with auditing and supervision departments.
