Article 1 In order to strengthen the management of basic vegetable field protection areas, stabilize the area of ??vegetable fields, do a good job in vegetable field construction, and ensure the supply of urban vegetables, in accordance with the "Land Management Law of the People's Republic of China" and the "Heilongjiang Province Land Management Implementation Regulations" and other relevant laws and regulations, combined with the actual situation of our city, to formulate these regulations. Article 2 These regulations apply to the management of basic vegetable field protection areas in this city’s urban areas.

The term "basic vegetable field protection zone" as mentioned in these regulations refers to the vegetable fields and new vegetable field development reserves determined in the city's urban basic vegetable field protection zone plan approved by the Provincial People's Government (hereinafter referred to as reserved land).

Basic vegetable field protection areas are divided into long-term protection areas, medium-term protection areas and short-term protection areas. Article 3 The management of basic vegetable field protection areas shall implement the policy of “fully cherishing and rationally utilizing land” and adhere to the principle of combining professional department management and mass supervision. Article 4 The municipal and district people's governments shall incorporate the planning, protection and construction of basic vegetable field protection areas into the national economic and social development plans.

A responsibility system should be established step by step for the management of basic vegetable field protection areas. Article 5 These Regulations shall be organized and implemented by the planning and land management department and agricultural department of the Municipal People's Government in accordance with their duties and powers. Article 6 The basic vegetable field protection zone plan shall be prepared by the municipal people's government, organized by the planning land management department and agriculture and other relevant departments, based on the urban economic and social development and population changes, based on the overall land use plan and agricultural resource survey zoning, and reported to the provincial people. Government approval.

When the planning of the basic vegetable field protection zone needs to be adjusted, it shall be handled in accordance with the procedures specified in the previous paragraph. Article 7 Municipal and district planning and land management departments and township (town) people's governments should establish basic vegetable field protection files.

The municipal and district planning and land management departments should organize the township (town) people's governments to set up nationally unified protection signs in the basic vegetable field protection areas, and issue uniformly printed "Basic Vegetable Fields" to village collective economic organizations. "Field Protection Card". Article 8 During the protection period of the basic vegetable field protection zone, no unit or individual may requisition or occupy it except for key national, provincial and municipal construction projects.

Key construction projects that require the requisition or occupation of vegetable fields or reserved land shall obtain the consent of the municipal agriculture department, review it by the municipal planning and land management department, and submit it for approval in accordance with statutory approval procedures. Article 9: In addition to paying land compensation fees and resettlement subsidies in accordance with the law, construction units that have been approved to requisition or occupy vegetable fields or reserved land shall also pay new vegetable field development and construction funds to the planning and land management department in accordance with the prescribed standards. No unit or individual has the right to reduce, exempt or defer the new vegetable field development and construction fund.

For those who have not fully paid the new vegetable field development and construction fund, the land acquisition (allocation) procedures will not be processed. Article 10 The scope of use of the new vegetable field development and construction fund:

(1) Survey and planning of basic vegetable field protection areas;

(2) Development and construction of new vegetable fields;< /p>

(3) Vegetable field regulation, improvement and fertilization;

(4) Infrastructure construction and maintenance of basic vegetable field protection areas;

(5) Technical training, scientific experiments, and new technology promotion for building basic vegetable fields. Article 11 The new vegetable field development and construction fund shall be managed as extra-budgetary funds and shall be stored in a special account and used exclusively for special purposes. Article 12 When a construction unit requisitions or occupies vegetable fields or reserved land, it shall carry out construction within six months after approval. It is not allowed to requisition (occupy) the land without using it for a long time, causing desolation. Article 13 The municipal agricultural department shall organize the construction of vegetable fields and the development of new vegetable fields in a planned manner within the basic vegetable field protection zone. Article 14 For vegetable fields in long-term protected areas, the standardized construction of greenhouses, greenhouses, water conservancy, farmland shelterbelts, roads, power supply and other infrastructure should be strengthened; for vegetable fields in medium-term protected areas, supporting infrastructure should be improved; No new infrastructure will be built for the vegetable fields in the protected area in the near future. Article 15 The funds required for the construction of infrastructure in fund vegetable field protection areas shall be raised jointly with the contractor, village, township (town), district, and municipal government to ensure that the funds are received in a timely manner and are earmarked for special use. Article 16 For the infrastructure in the basic vegetable field protection zone, the management unit or contractor shall establish facility files, clarify responsibilities, carry out maintenance and management, and keep the facilities intact. Article 17 When the land in the basic vegetable field protection zone is requisitioned in accordance with the law, the compensation fees for its infrastructure shall be recovered by the investing parties in proportion to their investment. Article 18 If a new construction project is built near a basic vegetable field protection zone and damages the infrastructure of the basic vegetable field protection zone, the construction unit shall repair it according to the original facility standards and repair the vegetable fields or reserved land involved in the damaged infrastructure according to the standards. Direct losses will be compensated. Article 19 The municipal agricultural department shall, based on the principle of combining land use and land cultivation, establish a system for rational fertilization and land cultivation in basic vegetable field protection areas, and organize its implementation.

Municipal and district agricultural departments should organize scientific research and technology promotion departments and contractors to conduct scientific research on the maintenance and construction of vegetable fields and reserved lands and the development of new vegetable fields, promote new technologies, and improve the quality of the land. production capacity. Article 20: Vegetable fields and reserved land are operated under contract, and the legitimate rights and interests of both parties to the contract are protected by law.

The village collective economic organization and the contractor should clarify in the contract the rights and obligations of the protection of vegetable fields and reserved land, infrastructure management and maintenance, and fertilization and land cultivation. Article 21 The vegetable fields or reserved land contracted by the contractor are not allowed to be left uncultivated except for serious natural disasters due to force majeure.
