Chapter I General Provisions Article 1 In order to prevent and control soil erosion, protect and rationally utilize soil and water resources, mitigate floods, droughts and sandstorms, improve the ecological environment and promote economic development, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on Soil and Water Conservation and other relevant laws and regulations, and in combination with the actual situation of this Municipality. Article 2 The term "soil and water conservation" as mentioned in these Measures refers to the preventive and control measures for soil erosion; Soil erosion refers to the destruction and loss of soil and water resources caused by natural factors and human activities. Article 3 These Measures shall apply to the prevention, control, supervision and management of soil erosion within the jurisdiction of Dalian. Article 4 The work of soil and water conservation shall follow the principles of giving priority to prevention, overall planning, comprehensive prevention and control, adjusting measures to local conditions, strengthening management and paying attention to benefits; Adhere to the principle of unified management of urban and rural areas, graded responsibility, first approval and then development, and whoever develops and builds will be responsible for governance. Fifth city and county (city), the Department of water administration of the District People's government is responsible for the work of soil and water conservation within their respective administrative areas.

The water and soil conservation work in Zhongshan District, Xigang District, Shahekou District and Dalian High-tech Industrial Park shall be undertaken by the water administrative department of Dalian City.

Water and soil conservation supervision and management institutions of water administrative departments at all levels shall be specifically responsible for water and soil conservation. Article 6 Relevant departments of planning, urban construction, land planning, environmental protection, agriculture, forestry, transportation, geology and mineral resources, finance, industry and commerce administration, price control, public security, justice, etc. at all levels shall, in accordance with laws and regulations, cooperate with the water administrative department to do a good job in soil and water conservation. Seventh to encourage scientific and technological research on soil and water conservation, improve the scientific and technological level of soil and water conservation, popularize advanced technology of soil and water conservation, and cultivate scientific and technical personnel of soil and water conservation. Chapter II Planning and Planning Article 8 Water and soil conservation planning shall be incorporated into the overall planning of social and economic development and coordinated with the national land planning and the overall urban planning. Article 9 The municipal, county (city) and district water administrative departments shall, on the basis of investigation and evaluation of water and soil resources, work out water and soil conservation plans in conjunction with relevant departments, delimit key prevention and protection areas, key supervision areas and key control areas of water and soil loss, and report them to the people's government at the same level for approval. The approved people's government shall publish key prevention and protection areas, key supervision areas and key governance areas, and set up signs. Tenth approved water and soil conservation planning is the basic basis for the development and utilization, protection of water and soil resources and prevention and control of soil erosion. Water and soil conservation planning shall not be modified or changed without authorization. If it is really necessary to modify or change, it must be approved by the original approval authority. Article 11 The county (city) and district water administrative departments shall, according to the water and soil conservation plan and under the guidance of the municipal water administrative department, formulate the annual implementation plan of key water and soil loss prevention and protection areas, key supervision areas and key governance areas within their respective jurisdictions, and report them to the people's government at the same level for approval. Article 12 People's governments at all levels shall incorporate the tasks defined in the water and soil conservation plan and the annual implementation plan of key prevention and protection areas, key supervision areas and key control areas of water and soil erosion into the national economic and social development plan, arrange special funds, organize their implementation, and raise funds for water and soil conservation in accordance with the following provisions:

(a) small irrigation and water conservancy subsidies from ten percent to twenty percent;

(two) from the poverty alleviation funds, agricultural comprehensive development fund to extract a part;

(3) Work-for-relief funds used for soil and water conservation according to regulations;

(four) the afforestation fund extracted from the forest regeneration and harvesting income invested by the water administrative department;

(5) Fees and compensation fees for prevention and control of soil erosion collected according to law.

The above funds should be stored in special accounts, proposed by the water administrative department, and earmarked for soil and water conservation after approval by the financial department.

Encourage units and individuals to raise or absorb social funds for soil erosion control according to law. Chapter III Prevention Article 13 People's governments at all levels shall take measures such as planting, engineering and agricultural cultivation to strengthen the construction, maintenance and management of vegetation and soil and water conservation engineering facilities, organize the whole people to plant trees and grass, expand the vegetation coverage area and prevent soil erosion.

No unit or individual may destroy or occupy soil and water conservation facilities. Article 14 It is forbidden to plant crops on steep slopes above 25 degrees (inclusive).

It is forbidden to borrow soil, dig sand, quarry, pile up waste and damage vegetation in the following areas:

(a) the danger zone of collapse and landslide;

(2) debris flow prone areas;

(3) Delineating reservoir protection areas;

(four) in the protected areas on both sides of railways, highways, channels and rivers. Fifteenth to engage in the following activities, an environmental impact report must be formed, which must include the water and soil conservation plan; If there is no need to form an environmental impact statement, a water and soil conservation plan shall be prepared;

(a) the construction of railways, highways, water conservancy projects, the establishment of electric power, mining, tourism and other industrial and commercial enterprises;

(two) burning bricks and lime in mountainous areas, hilly areas and sand areas;

(three) in urban and rural planning areas, development and construction may cause soil erosion or reduce the function of soil and water conservation.

The water and soil conservation plan shall be examined and agreed by the water administrative department. Article 16 The contents of the water and soil conservation plan include:

(a) the location, area and topography, landforms and vegetation of the construction project;

(two) the location, quantity and area of waste soil and slag;

(3) Soil erosion prediction;

(four) the prevention and control measures of soil erosion and the annual implementation plan;

(five) prevention and control cost budget and investment benefit analysis;

(six) other issues that need to be explained.
