Measures for fund management of large and medium-sized reservoir resettlement support fund projects?
Rule number one In order to strengthen the management of large and medium-sized reservoir resettlement support fund project funds (hereinafter referred to as project funds) and improve the standardization, safety and effectiveness of the use of funds, according to the State Council's Opinions on Improving the Post-resettlement Support Policy for Large and Medium-sized Reservoirs (Guo Fa [2006] 17) and the Administrative Measures for Central-local Special Transfer Payment (FB [2015]) ?
Rule number two The term "project funds" as mentioned in these Measures refers to the funds raised by the central government in the resettlement support fund for large and medium-sized reservoirs according to the provisions of document 17, and distributed to provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps (hereinafter referred to as provinces) every year according to the number of rural immigrants approved by the state and the prescribed support standards. These Measures shall apply to the allocation, use, management and supervision of project funds. ?
The management of the use of project funds follows the principles of scientific standardization, openness and transparency, overall consideration, highlighting key points, performance management and strengthening supervision. ?
Rule three. Project funds are managed by the Ministry of Finance in conjunction with the Development and Reform Commission and the Ministry of Water Resources. The Ministry of Finance is responsible for the preparation of the project fund budget, jointly with the Development and Reform Commission and the Ministry of Water Resources to determine the project fund allocation plan and issue the budget, organize the budget performance management, and guide the local financial departments to strengthen the project fund management. ?
Development and Reform Commission, Ministry of Water Resources and relevant local departments shall do relevant work according to the division of responsibilities. ?
Article 4? The expenditure scope of project funds includes:
(1) Support infrastructure construction and economic and social development in reservoir areas and resettlement areas. ?
1. Construction of basic grain ration fields and supporting water conservancy facilities. ?
2. Infrastructure construction such as transportation, power supply, communication and social undertakings. ?
3. Ecological construction and environmental protection. ?
4. Employment skills training and vocational education for migrant workers. ?
5. Production and development projects that immigrants can directly benefit from. ?
6 other projects closely related to the production and life of immigrants. ?
(two) the central government to implement the large and medium-sized reservoir resettlement support policy special funds expenditure. ?
(3) Other expenditures approved by the State Council. ?
Project funds shall not be used for financial subsidies for personnel expenses and operating expenses, purchase of transportation and office equipment, construction of buildings and halls, and repayment of debts. ?
Article 5? According to the principle of strictness and strictness, each province can allocate monitoring and evaluation fees for the implementation of resettlement support policies for large and medium-sized reservoirs in the project funds, which will be determined by the provincial finance department in conjunction with the provincial resettlement management institutions. ?
Article 6? Project funds are mainly allocated by factor method, and the allocation factors and weights are as follows:
(a) the number of rural migrants in large and medium-sized reservoirs approved by the provinces (weight 50%). Based on the population supported by large and medium-sized reservoirs in the later period of rural migration approved by the Ministry of Water Resources, the Development and Reform Commission and the Ministry of Finance. ?
(two) the contribution to the overall planning of the national large and medium-sized reservoir resettlement support fund (weight 15%). Based on the support funds paid by the Ministry of Finance for the resettlement of large and medium-sized reservoirs. ?
(three) the outstanding problem of reservoir resettlement (weight 20%). Based on the outstanding problems of reservoir resettlement determined by the Development and Reform Commission, the Ministry of Finance and the Ministry of Water Resources according to the economic and social development of reservoir areas and resettlement areas. Before the task of poverty alleviation is completed, the number of poor immigrants in the card shall be subject to national standards. ?

The central government's special funds for the implementation of resettlement support policies for large and medium-sized reservoirs are approved according to the actual workload every year, and are included in the departmental budget of the Ministry of Water Resources after being audited by the Ministry of Finance in conjunction with the Development and Reform Commission. ?
Other expenditures approved by the State Council shall be allocated by quota. ?
Article 7? Item (1) of Article 4 of these Measures is listed in the government revenue and expenditure classification subject "2082202 Infrastructure Construction and Economic Development", and items (2) and (3) are listed in? "2082299 Other large and medium-sized reservoir resettlement support fund expenditure". ?
Article 8? The Ministry of Finance shall, before June 3 1 of each year, issue the budget targets for the next year's project funds to the provincial finance department in advance according to the prescribed proportion, and send a copy to the Development and Reform Commission, the Ministry of Water Resources and the Office of the Financial Ombudsman of the Ministry of Finance (hereinafter referred to as the Office of the Commissioner). The Ministry of Finance will issue a formal budget for project funds to the provincial finance department within the specified time, and the next year can be liquidated according to the collection of support funds for the resettlement of large and medium-sized reservoirs.
Article 9? Financial departments at all levels and immigration management institutions should strengthen the performance management of project funds, establish and improve the performance management mechanism of the whole process budget, and improve the efficiency of the use of financial funds. Measures for performance management shall be formulated separately. ?
Article 10? Financial departments at all levels and immigration management agencies should strengthen the management of project funds, speed up budget implementation, and ensure the safe use of funds. Balance fund carry-over shall be handled in accordance with the relevant provisions of the Ministry of Finance on the management of balance fund carry-over. ?
Article 11? The payment of project funds shall be implemented in accordance with the relevant provisions of the centralized treasury payment system. Belong to the scope of government procurement management, in accordance with the relevant laws and regulations of government procurement. ?
Article 12? The use and management of project funds should fully implement the relevant requirements of financial budget information disclosure. ?
Thirteenth financial departments at all levels and immigration management agencies should strengthen the supervision and inspection of project funds, and correct problems in time. The Commissioner's Office shall supervise the project fund budget according to the job responsibilities and the requirements of the Ministry of Finance. ?
Fourteenth local financial departments at all levels, immigration management agencies and fund users should accept the supervision and inspection of higher-level financial, development and reform, water conservancy, auditing, supervision, immigration and other departments, and provide relevant information in a timely manner. No unit shall obstruct or escape for any reason. ?
Article 15 In case of financial violations such as fraud, interception, misappropriation and misappropriation in the use of project funds, the relevant units and individuals shall be punished in accordance with the Budget Law of the People's Republic of China and the Regulations on Penalties and Punishment for Financial Violations, and legal responsibilities shall be investigated if the circumstances are serious. ?
Financial departments at all levels, immigration management agencies and other relevant units and their staff illegally allocate or use funds, and abuse their powers, neglect their duties, engage in malpractices for selfish ends and other illegal acts. According to the Budget Law of the People's Republic of China, the Civil Service Law of People's Republic of China (PRC), the Supervision Law of People's Republic of China (PRC), the Regulations on Punishment of Financial Violations, the Regulations on Land Requisition Compensation and Resettlement for Large and Medium-sized Water Conservancy and Hydropower Projects, and the Measures for Investigating the Responsibility for Violating the Management Provisions on the Collection and Use of Support Funds for the Late Resettlement of Large and Medium-sized Reservoirs; Those suspected of committing a crime shall be transferred to judicial organs for handling. ?
Article 16 The provincial financial departments shall, jointly with the provincial development and reform departments and immigration management institutions, formulate corresponding implementation rules according to these Measures, and send a copy to the Ministry of Finance, the Development and Reform Commission, the Ministry of Water Resources and the Office of the Commissioner. ?
Article 17? These Measures shall be interpreted by the Ministry of Finance in conjunction with the Development and Reform Commission and the Ministry of Water Resources. ?
Article 18? These Measures shall come into force as of the date of issuance.
