The Anhui Provincial Food and Drug Administration issued the "Implementation Measures for Unannounced Drug Inspections in Anhui Province" (Draft for Comments (referred to as the "Measures")), stating that when necessary, the drug regulatory department can jointly carry out unannounced inspections in conjunction with the public security organs and other relevant departments.

In other words, in the future, unannounced inspections of pharmacies may not only include staff from the drug regulatory department, but also police from the public security agency, prosecutors from the procuratorial agency, or judges from the court.

The "Measures" also pointed out that if the unannounced inspection organized by the Provincial Food and Drug Administration finds that illegal activities need to be filed for investigation and punishment, the case can be filed directly for investigation and punishment, or the corresponding drug supervision and management department can be designated according to regulatory responsibilities to investigate and deal with, and follow up the supervision and investigation.

If any illegal conduct is discovered during unannounced inspections organized and implemented by the municipal or county drug regulatory authorities, the case shall be directly filed for investigation and punishment.

If the illegal conduct discovered during the unannounced inspection is suspected of being a crime, the drug supervision and administration department responsible for filing and investigating the case will transfer it to the public security organ, with a copy sent to the procuratorate at the same level.

After the drug regulatory department jointly carries out unannounced inspections of pharmacies with multiple departments, once it is discovered that a pharmacy has violated the law, it will directly handle the case jointly, file a case for investigation, and provide direct "one-stop service" for prosecution and litigation.

The Food and Drug Administration will cooperate with the Medical Insurance Bureau to inspect pharmacies: Recently, the Shaanxi Provincial Food and Drug Administration and the Medical Insurance Bureau jointly issued the "Notice on Carrying out Special Inspections on the Centralized Procurement of Nationally Organized Drugs and the Use of Selected Drugs" (hereinafter referred to as the "Notice").

In accordance with the requirements of the notice, from the date of issuance to the end of June 2020, drug distribution companies, relevant medical institutions and drug retail companies involved in the selected drugs need to conduct self-examinations and conduct risk assessments on situations that may affect drug quality and violate relevant medical insurance policies.

Analyze the causes, formulate rectification measures, and form a self-examination and rectification report, which shall be submitted to the Provincial Food and Drug Administration and relevant branches, the Provincial Medical Insurance Bureau, and the Municipal (District) Medical Insurance Bureau.

Starting from July, for a period of three months, the Provincial Food and Drug Administration and its branches, the Provincial Medical Insurance Bureau and the municipal (district) medical insurance bureaus will jointly carry out centralized inspections of the selected drugs within their jurisdiction.

At present, joint inspections of drug retail companies by various provinces and cities are still in full swing.

During this inspection, more than 50 people were dispatched to form 12 inspection teams, and 22 retail pharmacies were inspected, focusing on inspections of licensed pharmacists on-the-job, drug procurement and acceptance, drug storage and maintenance, drug sales management, etc.
