Proportion of compulsory insurance rescue fund in Hainan Province

A certain proportion of compulsory insurance premium belongs to compulsory insurance rescue fund, usually between 1%-2%. Relief fund is a new system stipulated in Article 17 of Road Traffic Safety Law. This system is a supplement to the compulsory liability insurance for motor vehicle traffic accidents (hereinafter referred to as "compulsory insurance"). The purpose is to ensure that victims can get timely assistance or appropriate compensation through the rescue fund when they can't get compensation according to the compulsory insurance system and the infringer. Basic procedures for the relief fund to advance the relief expenses: If the relief fund needs to advance part or all of the relief expenses, the traffic administrative department of the public security organ shall notify the relief fund management institution in writing within 3 working days. After receiving the advance notice from the traffic administrative department of the public security organ and the application and related materials for medical institutions to advance outstanding rescue expenses, the relief fund management institution shall conduct an audit within five working days. In line with the advance conditions, the relief fund management institution shall transfer the relevant expenses to the account of the medical institution. It should be emphasized that Article 75 of the Road Traffic Safety Law stipulates: "Medical institutions shall promptly rescue the injured in traffic accidents, and shall not delay the treatment because the rescue expenses are not paid in time."

Basic procedures for the relief fund to advance funeral expenses: If the relief fund is needed to advance funeral expenses, the relatives of the victims shall submit a written application for advance payment to the relief fund management institution on the basis of the Notice on Disposal of Corpse issued by the traffic management department of the public security organ handling road traffic accidents and their identity certificate. After receiving the application for advance payment of funeral expenses and relevant supporting materials, the relief fund management institution shall pay the funeral expenses in advance in accordance with relevant standards within three working days, and notify the traffic management department of the public security organ in writing to deal with road traffic accidents. The ownerless or unrecognizable remains shall be handled by the public security department in accordance with relevant regulations.

The compulsory insurance relief fund is also a new system stipulated in the Road Traffic Safety Law. Its main purpose is to compensate the victims and infringers who can't get compensation according to the compulsory insurance system in traffic accidents through the rescue fund. This is a humanitarian practice, and it is not mandatory to add this exemption clause to all insurances.
