Legal analysis: the cost of occupational annuity is shared by the unit and individual employees. The unit pays 8% of the total wages of the unit, and the individual pays 4% of the wages paid by himself, which is withheld and remitted by the unit. The payment base of units and individuals is consistent with the payment base of basic old-age insurance for staff of government agencies and institutions. According to the economic and social development, the state adjusts the proportion of occupational annuity contributions of units and individuals in a timely manner.

The income from the investment and operation of the occupational annuity fund shall be included in the personal account of the occupational annuity or family annuity according to the regulations. At the same time, it is stipulated that the occupational annuity fund must be managed separately from the self-owned assets or other assets of the investment manager and custodian to ensure the independence of the occupational annuity property and shall not be used for other purposes.

Legal basis: Article 12 of the Interim Measures for the Administration of Occupational Pension Funds. Institutions and institutions that establish occupational annuities shall perform the following duties:

(a) to declare the occupational annuity payment to the social insurance agency that manages its basic old-age insurance.

(II) The occupational annuity payment of government agencies and institutions shall be transferred to the occupational annuity fund collection account established by the social insurance agency that manages their basic old-age insurance according to relevant regulations, and the funds from the occupational annuity fund collection account of the social insurance agency below the provincial level shall be collected into the occupational annuity fund collection account of the provincial social insurance agency in time to ensure the integrity, safety and independence of the funds. Measures for the establishment and management of occupational annuity fund collection accounts shall be formulated separately.

(3) According to the relevant regulations, when the staff of this unit retire, go abroad (settle down), die, etc. , apply to the social insurance agency that manages its basic old-age insurance group to assist in the payment of occupational annuity benefits; When the staff of this unit changes their work units, they shall apply for account transfer to the social insurance agency that manages their basic old-age insurance, and assist in the transfer of occupational annuity accounts; In case of the above or other relevant circumstances, the staff of this unit shall apply to the finance at the same level for recording the allocated funds.
