◆Adoption conditions

1 General necessary conditions for adoption stipulated in relevant national laws:

Sixth Article 1 The adopter shall meet the following conditions at the same time:

(1) No children;

(2) Have the ability to raise and educate the adoptee;

(3) ) Not suffering from any disease that medically deems it inappropriate to adopt children;

(4) Aged 30 or above.

Article 8 An adopter can only adopt one child. Adoption of orphans, disabled children, or abandoned babies and children raised by social welfare institutions whose biological parents cannot be found is not subject to the restrictions on the adopter having no children and adopting one child.

Article 9: If a man without a spouse adopts a woman, the age difference between the adopter and the adoptee shall be more than forty years. If a spouse adopts a child, the couple must adopt the child together.

Article 11 Adoption by the adopter and placement by the person for adoption must be voluntary by both parties. When adopting a minor who is over ten years old, the adoptee's consent must be obtained.

2 The conditions required for the adoption of orphans from disaster areas will be more specific. Currently, specific conditions for adopters of earthquake orphans need to be consulted with relevant departments.

◆Application and adoption procedures

Two procedures

Currently, there are two application procedures for adopting earthquake orphans.

1 If it is confirmed that both parents of these orphans are dead after the disaster and close relatives give up their custody rights, they can enter the adoption process.

2 The government can pay to find a foster family to raise the child.

According to the current policy, orphans are managed according to their household registration. If someone wants to adopt or adopt, they need to bring relevant documents to the civil affairs department in Sichuan to apply for it, and the local civil affairs department will review it. If the orphan has immediate relatives, the consent of the immediate relatives must be obtained before consent can be given.

According to the "Measures for the Registration of Adopted Children by Chinese Citizens", the parties involved in the adoption relationship should go to the adoption registration authority in person to complete the registration procedures for establishing the adoption relationship.

Article 5 of the Measures lists that the adopter shall submit an adoption application and certificates and supporting materials to the adoption registration authority:

(1) The adopter’s household registration book and resident status Identity card;

(2) Proof of the person’s marital status, whether they have children and their ability to raise and educate the adopted person, etc. issued by the adopter’s unit or village committee or residents’ committee;

(3) A physical health examination certificate issued by a medical institution at or above the county level stating that the child does not suffer from any disease that is medically deemed inappropriate for adoption.

According to this regulation, these procedures are necessary when adopting Sichuan earthquake orphans.

Since the adoption of earthquake orphans has not yet entered the specific implementation stage, citizens who intend to adopt need to submit an application at this stage.
