Interim Measures of Hefei Municipality on the Administration of Unemployed Persons.

Chapter I Management Responsibilities

Article 1 In order to further standardize the management of unemployed persons, ensure their basic livelihood during unemployment and promote their re-employment, these Measures are formulated in accordance with the Measures of Hefei Municipality on Unemployment Insurance.

Article 2 The term "unemployed persons" as mentioned in these Measures refers to those who have terminated or dissolved their labor relations with the units that have participated in unemployment insurance according to law and registered for unemployment in the unemployment insurance agencies.

Article 3 The municipal administrative department of labor security is the competent department in charge of the management of the unemployed in the whole city. The unemployment insurance agency to which it belongs undertakes the specific management of the unemployed and performs the following duties:

(a) to implement the relevant provisions of the State Council and the provincial and municipal governments;

(two) to formulate plans and policies for the management of the unemployed in this area;

(three) responsible for the registration and management of unemployed people in the city and organizing pre-job training;

(four) responsible for the management of the city's unemployment insurance fund;

(five) responsible for the approval and payment of unemployment insurance benefits for the unemployed in the city;

(six) according to the provisions of the unemployed vocational training, job introduction subsidies;

(seven) responsible for the investigation and statistics of the unemployed in the city;

(eight) to guide the specific management of unemployed people in three counties and four districts;

Article 4 The unemployment insurance agency affiliated to the administrative department of labor and social security in the district shall perform the following duties:

(a) to be responsible for receiving and keeping the files of unemployed persons with permanent residence in this area;

(two) responsible for verifying the standard of unemployment insurance benefits for unemployed persons in their respective jurisdictions and filling in the list and notice of issuing certificates for unemployed persons;

(three) the relevant reports submitted by the streets in this area;

(four) to cooperate with the municipal unemployment insurance agency to organize the pre-job training for the unemployed;

(five) responsible for the retirement procedures and management of the unemployed in this area;

(six) to guide the management of unemployed people in the streets within their respective jurisdictions.

Fifth street employment and social security workstations (hereinafter referred to as street workstations) are mainly responsible for the management of unemployed people:

(a) responsible for the registration and certification of the unemployed in this street, and establish the management account of the unemployed;

(two) responsible for the signing, declaration and payment of monthly unemployment insurance benefits for unemployed people in this street;

(three) responsible for the statistics of unemployed people with training needs and job-seeking aspirations in this street;

(four) to guide the management of the unemployed in the neighborhood committees of this street.

Article 6 The main duties of the Employment and Social Security Studio of the Social Neighborhood Committee (hereinafter referred to as the Social Neighborhood Committee Studio) concerning the management of unemployed persons are: to know the situation according to the list of unemployed persons provided by the street, and to establish contact cards one by one.

Chapter II Unemployment Registration

Article 7 Before unemployment, the unit where the unemployed worked shall, within 7 working days from the date of termination or dissolution of labor relations, report the list of persons who terminated or dissolved labor relations, files, certificates of payment of unemployment insurance premiums by units and employees and other related materials to the municipal unemployment insurance agency for the record. After receiving the files of unemployed persons and other materials, the municipal unemployment insurance agency shall classify the files into districts according to household registration within 7 working days, and notify the district unemployment insurance agency to reclaim them. The district unemployment insurance agency shall, within 7 working days, issue the Notice of Issuance of Unemployed Persons and the List of Unemployed Persons to the street workstation where the unemployed persons are located.

Eighth unemployed persons shall, within 60 working days from the date of termination or dissolution of labor relations, hold the certificate issued by the original unit to the municipal unemployment insurance agency for unemployment guidance and training.

Article 9 Unemployed persons shall, within 7 working days after participating in unemployment guidance training, fill in the Registration Form of Unemployed Persons at the street workstation where their household registration is located with the training certificate, certificate of termination or dissolution of labor relations, household registration book, ID card and two bareheaded photos of 1 inch, and go through the unemployment registration formalities.

Tenth street workstation according to the district unemployment insurance agencies issued the "unemployed registration list", for the "unemployed registration certificate" and related matters, and within 7 working days, the "unemployed registration certificate" issued to the unemployed.

When the unemployed go through the formalities of re-employment, transfer the file relationship and retire or die, the street workstation shall promptly recover the registration certificate of the unemployed.

Chapter III Application and Payment of unemployment insurance benefits

Eleventh unemployed people who meet the conditions stipulated in Article 15 of the Measures for Unemployment Insurance in Hefei can apply for unemployment insurance benefits and enjoy other unemployment insurance benefits. Among them, those who voluntarily dissolve the labor relationship refer to the following personnel: (1) those who dissolve the labor contract; (2) The employer terminates the labor contract; (3) Being expelled, removed or dismissed by the employing unit; (4) Terminating the labor contract with the employer according to Article 32 of the Labor Law of People's Republic of China (PRC) (see Annex 4); (5) Other circumstances stipulated by laws and administrative regulations.

The following persons are not entitled to unemployment insurance benefits: (1) Resign; (2) Resignation; (3) Joining the army; (4) going abroad to settle down; (5) Other circumstances stipulated by laws and regulations.

Article 12 When the unemployed apply for unemployment insurance benefits, they shall fill in the Application Form for Unemployment Insurance Benefits and the Registration Form for Job-seekers, establish a career guidance tracking service card, and promise to actively apply for a job and receive vocational training before they can enjoy unemployment insurance benefits according to regulations.

Thirteenth unemployed people to apply for unemployment insurance benefits is confirmed, from the next month to receive unemployment insurance benefits. The time limit for receiving unemployment insurance benefits shall be calculated from the date of registration. After the unemployed are approved to receive unemployment insurance benefits, in addition to the approval of the district unemployment insurance agency, they should go to the street workstation to sign and receive the formalities on June 1-5 every month (postponed on weekends and holidays). Unemployed people do not go through the signing formalities in the current month without justifiable reasons, and their unemployment insurance benefits in the current month will be deemed as a waiver and will not be reissued.

Fourteenth unemployed people to apply for unemployment insurance money for a one-time period of up to six months. If you are not employed after the expiration of an application, you must apply again if you want to continue to get it. According to the job hunting situation, the street and district where the registered permanent residence is located shall determine whether it can continue to receive unemployment insurance benefits during the later application period.

Fifteenth unemployed people who are unemployed again after re-employment, the time limit for re-enjoying unemployment insurance benefits is re-approved according to the payment time after re-employment, and can be combined with the previous time limit for not receiving unemployment insurance benefits, and the combined calculation period can not exceed 24 months.

Article 16 If an unemployed person falls ill and is hospitalized during the period of receiving unemployment insurance benefits, he can apply to the street workstation where his/her registered residence is located for receiving medical subsidy according to the regulations, and provide materials such as hospitalization list, discharge list, registration certificate of unemployed person, original invoice of medical expenses, personal medical record, etc.

Included in the approved Medicaid hospitalization project scope, with reference to the relevant provisions of the basic medical insurance for urban workers.

Article 17 If an unemployed person dies during the period of receiving unemployment insurance benefits, his/her family members can receive a one-time funeral subsidy and pension at the street workstation where the household registration is located on the strength of the unemployed person's death certificate, unemployed person's registration certificate, recipient's ID card and proof of relationship with the unemployed person. Unemployed persons who have not received unemployment insurance benefits in the current month may receive them from their family members.

Eighteenth unemployed people flow across the overall planning area, the unemployment insurance relationship such as the record of paying unemployment insurance premiums in the place where they moved out will be transferred accordingly. The unemployment insurance agency in the place of emigration shall transfer the unpaid unemployment insurance benefits to the unemployment insurance agency in the place of emigration, and the unemployment insurance agency in the place of emigration shall pay it monthly according to the unemployment insurance standard in the place of emigration. This period is the month when the unemployed move out. At the same time, the unemployment insurance agency in the place of emigration should also calculate the subsidies for Medicaid, vocational training and job introduction according to 50% of the unemployed who have not received unemployment insurance benefits, and transfer them to the unemployment insurance agency in the place of emigration.

Nineteenth unemployed people who meet the requirements of enjoying the minimum living guarantee for urban residents during or after receiving unemployment insurance benefits may apply to the street workstation where their household registration is located for enjoying the minimum living guarantee for urban residents according to regulations.

Twentieth unemployed persons in the period of receiving unemployment insurance benefits, the occurrence of "Hefei unemployment insurance measures," one of the provisions of Article 23, shall not continue to receive unemployment insurance benefits and enjoy other unemployment insurance benefits.

Twenty-first unemployment insurance payments on a monthly basis, issued by the district unemployment insurance agencies vouchers, unemployed people with vouchers to the designated bank to receive.

Chapter IV Training and Employment Services for Unemployed Persons

Twenty-second unemployed people can participate in skills training free of charge at the designated vocational training unit approved by the municipal labor training center or the administrative department of labor security with the unemployment registration certificate. After passing the training, a certificate of completion will be issued.

Twenty-third street workstations are responsible for organizing the registration of unemployed people with vocational skills training needs, and the district unemployment insurance agencies regularly summarize and report to the municipal labor and employment training center for training (or joint training at the municipal and district levels).

Twenty-fourth training institutions should implement microcomputer management for all unemployed people who participate in vocational training and vocational skill appraisal, establish training files for unemployed people, and regularly recommend them to municipal and district public employment agencies.

Twenty-fifth unemployed people can voluntarily enter the human resources library of the city employment center free of charge with the unemployment registration certificate; And can participate in the recruitment activities organized by the municipal and district public employment agencies for free.

Twenty-sixth unemployed people should try their best to find jobs during the period of unemployment. If they refuse the vocational training and job introduction recommended by the municipal and district labor and social security departments twice in a row without justifiable reasons, they will stop receiving unemployment insurance benefits that they did not receive during the application period.

Twenty-seventh unemployment insurance agencies at all levels should actively guide and help the unemployed to achieve re-employment, provide employment information, career guidance and policy advice to the unemployed through various forms, and help the poor unemployed to achieve employment and other services.

Chapter V Archives Management of Unemployed Persons

Twenty-eighth unemployed file management work content:

1, receiving, sorting, keeping and forwarding the files of the unemployed;

2, issued by the unemployment appraisal, academic degree, political examination abroad and other relevant certificates;

3, according to the provisions of the relevant departments to provide the unemployed file utilization;

4, maintain the integrity and safety of the unemployed files, do a good job of confidentiality and protection;

5, supplement and improve the relevant archival materials produced during unemployment;

6, handle the unemployed file related matters.

Twenty-ninth unemployed file materials mainly include:

1, related information materials such as conscription, enrollment, transfer, employment, enlistment, retirement, demobilization and job transfer;

2, labor contracts, wages, insurance and welfare materials;

3. Materials for terminating or dissolving labor relations;

4. Resume materials;

5. Other materials that should be filed according to regulations.

Article 30 The files delivered by the Employer shall be systematically sorted and catalogued to be complete.

Thirty-first unemployed files are delivered by the employer, and unemployed people are not allowed to bring their own files.

Thirty-second city unemployment insurance agencies to receive files, must check the registration, after the audit for receiving procedures.

Article 33 When the unemployed are employed, the employing unit shall extract the files with the unemployed employment notice, unit file transfer letter, unit organization code certificate and other materials.

Thirty-fourth unemployed people need to transfer files because of further education, enlistment, etc. And they must extract files with valid certificates such as entering a higher school and joining the army and file transfer letters.

Thirty-fifth unemployed people can voluntarily choose the city and district employment agencies to manage files and continue the old-age insurance relationship after registering for unemployment.

Thirty-sixth unemployed people after retirement, their files are still kept by the district unemployment insurance agencies, and will be handed over to the relevant departments when the documents expire.

Chapter vi retirement of unemployed persons

Article 37 When the unemployed who participate in the basic old-age insurance and meet the retirement conditions reach the statutory retirement age, they shall submit a written application to the street workstation where their household registration is located, and report it to the municipal labor and social security administrative department for approval after being audited by the district unemployment insurance agency.

Thirty-eighth unemployed files entrusted to the municipal and district public employment agencies to handle labor and social security affairs, the retirement procedures shall be handled by the municipal and district public employment agencies.

Thirty-ninth basic pensions for unemployed people after retirement shall be socialized.

Chapter VII Others

Fortieth found that does not meet the conditions to enjoy unemployment insurance benefits, defrauding unemployment insurance benefits, in accordance with the "Hefei unemployment insurance measures" provisions of article twenty-ninth.

Article 41 If an unemployed person has a dispute with an unemployment insurance agency because he enjoys unemployment insurance benefits, he may apply to the unemployment insurance agency for review or to the administrative department of labor security for administrative reconsideration.

Forty-second cities under the jurisdiction of three counties can be implemented according to local actual conditions.

Article 43 These Measures shall come into force as of the date of promulgation.
