Special maintenance funds shall be used for the maintenance, renewal and transformation of property parts and facilities after the expiration of the warranty period, and shall not be used for other purposes. However, the special maintenance fund belongs to the owner, and its collection and use must be approved by the owner whose exclusive part accounts for more than 2/3 of the total construction area and accounts for more than 2/3 of the total number. Property units shall not dispose of or misappropriate them without authorization. Where a property right unit misappropriates special maintenance funds, it shall be recovered by the real estate administrative department of the local people's government at or above the county level, given a warning, and its illegal income shall be confiscated, and a fine of less than 2 times of the misappropriated amount may be imposed; Property service enterprises misappropriate special maintenance funds, and if the circumstances are serious, the qualification certificate may be revoked by the department that issued the qualification certificate; If the case constitutes a crime, the directly responsible person in charge and other directly responsible personnel shall be investigated for criminal responsibility according to law.
