Article 2 These Measures shall apply to the tendering and bidding activities of government-invested projects within the administrative area of this Municipality and the supervision and management of tendering and bidding activities.
the term "government investment projects" as mentioned in these measures refers to all kinds of housing construction, municipal infrastructure projects, ecological environment protection projects, and professional construction projects such as transportation, water conservancy, information engineering, etc., which are constructed by using budgetary funds, various special construction funds, international organizations, foreign government loans, aid funds, government financing and state-owned enterprises and institutions' own funds. Article 3 The municipal tendering and bidding management institution shall be responsible for the supervision and management of tendering and bidding activities of municipal government investment projects, and investigate and deal with illegal acts in tendering and bidding activities according to law. ?
the construction engineering trading center approved by the municipal government provides unified trading services for government investment projects and publishes relevant information. ? Article 4 The following government investment projects shall be traded in the Construction Engineering Trading Center:
(1) municipal government investment projects; ?
(2) government investment projects in Chengguan District, Qilihe District, Xigu District, Anning District, high-tech industrial development zones and economic and technological development zones;
(3) Construction projects with estimated investment of more than 1 million yuan by the governments of Yongdeng County, Yuzhong County, Gaolan County and Honggu District. ? Article 5 Government-invested projects, including project survey, design, construction and supervision, and procurement of important equipment and materials related to engineering construction projects, shall be subject to public bidding if they meet one of the following standards:
(1) The estimated price of a single construction contract is more than 5, yuan; ?
(2) the estimated price of a single contract for the procurement of important equipment, materials and other goods is more than 3, yuan; ?
(3) the estimated price of a single contract such as survey, design and supervision is more than 3, yuan; ?
(4) the estimated price of a single contract is lower than the standards specified in items (1), (2) and (3), but the total investment of the project is more than 1 million yuan. Article 6 In any of the following circumstances, government investment projects may be invited for bidding upon approval:
(1) The project technology is complex or has special requirements, and only a few potential bidders can choose from it; ?
(2) limited by the natural geographical environment; ?
(3) involving national security, state secrets or emergency rescue and disaster relief, it is necessary to invite public bidding, but it is not suitable for public bidding; ?
(4) the cost of the proposed public bidding is not equal to the value of the project;
(5) other circumstances that are not suitable for public bidding as stipulated by laws and regulations. ? Article 7 In any of the following circumstances, government investment projects may not be subject to construction bidding upon approval.
(a) involving national security, state secrets or emergency rescue and disaster relief, which is not suitable for bidding; ?
(2) it is necessary to use migrant workers to use poverty alleviation funds to implement work-for-poverty relief; ?
(3) the main construction technology adopts specific patents or proprietary technologies;
(4) the project built by the construction enterprise for its own use, and the qualification grade of the construction enterprise meets the engineering requirements; ?
(5) The original winning bidder still has the contracting ability for the additional subsidiary minor projects or main storey-adding projects of the projects under construction; ?
(6) other circumstances stipulated by laws and regulations. ? Eighth government investment projects bidding methods by the project examination and approval department in the examination and approval of the project, to be approved. ?
changes in the bidding methods of government-invested projects need to be examined and approved by the project examination and approval department, and changes in the bidding methods of key projects need to be reported to the Municipal People's Government for approval. Article 9 A government investment project that should be subject to tender according to law can only be subject to construction tender if it meets the following conditions:
(a) the approval of the project construction project; ?
(2) the planning permit or land use approval document of the construction project;
(3) There are corresponding funds or sources of funds that have been implemented; ?
(4) preliminary design approval documents; ?
(5) approval letter for construction drawing review; ?
(6) the review opinions of the project budget control price issued by the government investment project evaluation institution; ?
(7) qualifications of the tenderer or tendering agent, power of attorney and contract agreement;
(8) Other conditions stipulated by laws and regulations. ? Article 1 A tenderer of a government investment project may bid by himself or by entrustment. ?
if the tenderee does not meet the requirements for self-tendering as stipulated by relevant laws and regulations, it shall choose a tendering agency to entrust it to handle the tendering matters. ? Article 11 A tenderer of a government investment project shall, according to the characteristics and needs of the project subject to tender, prepare the tender announcement, pre-qualification documents and tender documents according to the standardized model text. ?
if the terms proposed by the tenderer are inconsistent with the model text, a special explanation shall be made. ? Article 12 A tenderer of a government-invested project shall list in the tender documents the veto clauses that deny the effectiveness of the tender documents, such as the rejection of bids or invalid bids, invalid bids and unqualified bids. If other clauses in the tender documents are inconsistent with or not listed separately, the single veto clause shall prevail. ?
